Timeline

I am not confused but not sure what to do. I realize the difference in the two visas and know in the past the time difference for approval has been somewhat long but lately I have been seeing a lot of CR-1 visas being approved in short times. I am just wondering if filing for both is that necessary, given the approvals I am seeing. Anyone else wondering what to do??? Just asking for some opinions or thougths from other people on this topic. I have most of the I-129F packet ready to go, just waiting for a new passport foto since the other is over the 30 day limit.

This is a decision that you have to take it by yourself. While we are seeing speedy I-130 approvals, no one can guarantee that how long this trend will continue. You can submit the passport size photo that you used for I-130 as long as they are recent. USCIS is not that picky to investigate whether the photo is really taken within the 30-day boundary.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

Same situation here, hubby just received my stuff for I-129f...the only thought i can have is to differentiate that Cr-1/Ir-1 is for more long term to be finished once and for all, as the K-3 is to more short term, but have after to redo the AOS...Hm!

25 Aug 06 - Sent I-130 (a Friday)

28 Aug 06 - NOA1 & Certif. receipt returned ( a Monday) Day 1

29 Aug 06 - USCIS cashes check

30 Aug 06 - check cleared & 1ST TOUCH.

01 Sept 06 - NOA1 recvd by Mail

09 Sept 06 - 2ND TOUCH (a Saturday)

09 Mai 07 - NOA2 (2 e-mails)

Note: were told the long delay due to huge backlog and internal changes in VT

NVC :

04-June-07 - NVC generates DS-3032 & AOS bill

12-June-07 - AOS Bill payment sent/ alien receives DS-3032 form (by mail, dated 4th June)

13-June-07 - Alien sends back completed DS-3032 (by mail)/ rcvd 19th of June approx.

To mid July-07 - I-864 form sent completed and IV fee bill

19-July-07 NVC rcv I-864 form; mail signature rcvd.

22-Aug-07 Ds-230 with documents sent to NVC.

20-Sep - 07 Alien sends NVC Missing document. NVC receives it the 25th.

05-Oct - 07 NVC completed.

16-Jan - 08 Interview, 3 questions asked, visa approved same day, received 1week later approx.

Note: delay due to internal delay, missing document (not rfe) and self procrastination of understanding some abstract terms. C Post not at all reliable (delivery duration, delivery with signature (did not deliver personnaly), and delivery of interview letter rcvd after the interview).

In USA:

01-03-08 POE Entry in USA

...-03-08 2 Welcome in America letters and green card received.

For me, it was worth the extra money to file both. In my husbands case the Cr1 was magically quicker (although not quick at all).

Timeline

Our CR1 and K3 both ended up at the consulate stage at the same time. I think the CR1 saves somes steps in the long run/offers benefits that the K3 doesn't? Regardless, good luck!

Approval Dates:

I130 Approved (NOA2) 7/20/06 (144 Days)

I129 Approved (NOA2) 8/24/06 (41 Days)

Documents we have so far:

Criminal/police record check.

Immunization records/medical history (including negative Tb, HIV, syphyllis, etc).

Chest x-ray.

His birth certificate (long form).

Our marriage certificate.

My divorce decree.

Our passports.

Wedding photos, cards, credit cards, health insurance, evidence of legitimate marriage.

Notarized I-134 and supporting documents.

Notarized I-184 and supporting documents.

Five additional passport photos each.

Thanks guys for the responses, I know it is always better to be safe than sorry, and in the long run, yes the CR-1 may save some later filings. Anyway, probably going to file both and again, thanks for your input and good luck to all!!!!

Our I-129 and I-130 were approved about the same time... My interview for I-129 is already schedulled here in Brazil for November. I'm glad for having my interview date for I-129..and I don't want to be here longer so far away from my husband.

Does anybody knows how long the I-130 takes to leave the NVC?

You have two choices.

1) Interview for the K-3 in November and adjust status in the US. You will need to advise NVC so they wont continue the CR-1 process with the approved I-130 and it will be returned to the USCIS when needed for the adjustment of status.

2) Interview for the K-3 and enter the US on such.....as well as continuing with the CR-1 process through NVC, which you can then return to the consulate for the CR-1 interview. Hence entering with immigrant status and nothing to do until 90 days before the two year anniversary of your entry to the US on the CR-1 when you will apply to remove conditions.

Both Adjustment of Status in the US after entering on the K-3, and, the CR-1 have the same outcome.......immigrant status.

Totally up to you and your circumstances as to how you would like to gain that immigrant status.

Good suggestions. I guess my 2 cents would be as you might already know, filing the k3 is not guarenteed to be faster than the CR1, although it is most times. I would think if you did both, it would be nice for your spouse to get to the US asap, but to consider canceling the I-130 would be counter productive IMOP. I would say since you already went to the extra expense of the K3, then a trip for the I-130 interview would just make life easier in the long run, IMOP

I-130 petition approved 4/16/2008 after 19 months.

Got IIN from NVC 5-13-08

Paid AOS fee online 5-14-08, Paid IV Fee online 5-27-08

Sent I-864 forms 5-27-08

Sent DS-230 forms 5-28-08

6-2-08 called NVC and msg says "received all information,processing will take 4-6 weeks"

6-13-08 called NVC, CR1 is complete, sent RFE for CR2. returned to NVC, waitn on result

6-26-08 case complete/approved. Waiting to be transferred to U.S. Embassy in Guangzhou, China for interview date

7-7-08 Petition forwarded to Guanzhou, China. Awaiting interview letter.
