Hello,

My husband is from Jordan and we have been married for 9 months now. I recently filed the CR-1 petition and was wondering if our age difference will cause a denial of the visa. I am 11 years older than my husband. We don't see a problem with the age difference but I've looked at some posts in which it could be a problem.

You can't help who you fall inlove with and I hope that this will not be an issue. If so, how can we prepare for this?

Please advise. Thank you.

We are the same here and my husband was questioned at length and I got a phone interview from the CO about a month and half after his interview. We had tons of supporting docs and his family all had attended the wedding etc so it was a non issue for his family. The CO was concerned which is why we were questioned so heavily but in the end our information and our answers were enough to satisfy the CO and he said at the end of our interview that our case was fine and we had nothing to worry about and that they were now putting my husband in name checks and once that was complete the visa could be issued.

All I can advise is get as much supporting docs as possible and be prepared for a lengthy interview...if that doesnt happen then that's wonderful but you would be prepared if it should. You shouldn't worry... the CO's are trained to see thru fraudulant marriages and see the genuine ones.

The more bonafide evidence and visits to eachother you have, the better. How much the age difference matters will also depend on your respective ages- 55 and 66 is not as much of a problem as, say, 32 and 43, as you could potentially be too old to have kids (and planning kids- or not- seems a big issue for COs when it comes to couples with age differences). Do you have any other red flags, such as his family not approving or being different religions, or either of you having been through the fiance/spousal visa process before?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I appreciate your feedback. We have a lot of evidence to support that we are in a true marriage. I just think that the CO may have a problem with our age difference but I'm hoping that it won't be. We are both prepared to answer any questions. I'm still young enough to bear children and we both want to have 2 children. My husband has no problem with the age difference and I'm sure that he's prepared to answer any question. I hope CO's are trained to see through fradulent marriages...ours isn't. :)

No, we don't have any other possible red flags and we both want to have children. Both of our families are very supportive and don't care about our age difference. But if my husband is questioned heavily about our age difference, he's prepared to answer any question the CO may ask. All he can do is speak the truth.

The only concern that I had previously was that he tried to come to the US on a tourist visa and he was denied. This happened before we were married. I posted this question before on whether or no that this would be an issue. I raised that issue because I read a post in which a petitioner stated that his/her spouse was denied for a tourist visa to come to the US and some VJers were advising the OP that they should list that on the I-130, Q16 - Has your relative been under immigration proceedings before?

I don't consider a tourist visa to be an immigration proceeding. This will be the same consulate who denied his tourist visa.

OP: Do the best you can to build bona-fide relationship evidence and then build some more. You should be OK but better safe than sorry.
