I need some advice....During my previous marriage I caught my wife cheating and I started to drink heavly. I was drinking so I would confront her about her afair. During our arguring, while drunk, she would start to throw things at me or hit me so I would grap her arm to keep her from hitting me. She would call the police and I go to jail. I have two charges from 2005 criminal domestic violence 1st offense 4/10/05, #2 simple assult and battery 5/25/05. These

were misdemeanors and I paid a fine.

I'm currently starting my I-129F paper work, my fiancee is aware of these charges. I completed alcohol rehab in 2008 and have been free of alcohol since then. I'm concerned that these charges on my record are going to prevent me from getting our visa approved. Should I consult a lawyer or what? Do I need a wavier? Can anyone give me some advice here?

I was not convicted of the CDV but it still shows on my record. I was convicted of the simple assult and battery and paid the fine for that conviction.

The CDV charge was dropped but is still showing on my report. I was only conviced of the #2 and paid a fine.

From what I have been reading here seems like if I have shared this information with my fiancee and have been honest, there shouldn't be a problem......anyone agree or not?

I agree. I don't think those arrests would be grounds for a denial of a k1 visa application.

December 2nd, 2011 - AOS Packet sent

December 8th, 2011 - Received electronic NOA1

January 3rd, 2012 - Received notification that case has been transferred to CSC

January 4th, 2012 - Biometrics

February 11th, 2012 - Employment Authorization Card received

February 25th, 2012 - Social Security Card received

August 24th, 2012 - Green Card Received

August, 2014 - I-751 sent

August 2014 (two weeks later) - NOA1 Received

March 2015 - RFE Received

May 2015 - RFE Packet Sent

July 28th - Letter received for interview

August 13th - Interview (GC Pending)

Always be honest.

Will it affect your petition ? I dont know. But youll never know unless you try.

Explain your side of the case in great detail. Remember that these are people reading your story, they will understand that sometimes people get into situations that maybe they didnt handle the proper way. It could be used against you, but maybe not. Also, they go by years, yours is now year 6. I know for Canadian immigration, after 5 years you could apply for a pardon, and after 10 years it was like the incident never happened. Does the USA immigration do this too ? Im not sure, but its sure worth a shot to be with your partner.

Dec 25 2009 officially engaged

March 2010 - sent off I-129F

March 27 2010 - Vermont receives package :)

April 3 2010 - Informed through mail that cheque is cashed NOA1

May 28 2010 - RFE notification ( yeah Im online checking alot >.< )

June 5 2010 - RFE hardcopy received

June 18 2010 - RFE returned ( had done it June 7 - but USPS returned grrrr )

--- case says we should hear from them in 60 days from June 18 ---

June 23 - Touched

Aug4 - Email notification of NoA2 :)

Aug. 10 - NOA2 Hardcopy received

Sept. 13 - Faxed off Package 3

Sept 14 - Interview notification set for Oct. 5

Oct. 5 2010 Interview Passed

March 17 2011 POE Canadian/US border

April 1 2011 Marriage

Mailed AOS June 1

Chicago Lockbox confirms delivery June 3

Check cashed through bank - notification June 9

I actually had a Federal conviction for battery (amongst lots of local convictions) and had no problems with the K-1 (I am the petitioner). They did discuss my history with my fiance briefly during the interview but other than that it was a non-issue.
