We already had the K1 approval prior to getting married.

K-1/K-2 AOS APPROVED IN ATLANTA MAY 17, 2006

10 year GC Approved - APRIL 16th ,2009 - Peggy and Jonathan's......

Still waiting for our cards...Had to file I-90 as they sent them to the wrong address.

March 9th, 2010, Received GC that has been lost in the mail for 10 months. Still waiting for my son's that is lost as well.

Filed Waiver for my son's 10 year GC and it was approved. He finally received his GC after its been missing for 2 years.

Thanking God this is over for 10 years.

The confusion is because you said you married in Columbia, a K1 is to allow her entry to the US to get married, if you marry in Columbia you need a K3.

Boiler is correct. If you filed for a K-1 then your Fiance would need to come into this country WITHOUT being married to you. She would need to arrive as your Fiance, not your wife. If you had a legal ceremony in her country then you've done something illegal. To enter as your wife she now needs a K-3 Visa. Seriously, seek help from an immigration lawyer.

November 16, 2006~ RFE reply received ...didn't even know we had an RFE (INS stated that the RFE was

probably sent to the DR. that did our biometrics)

January 17, 2007 ~ CSC is now processing cases received September 25 (11 days after ours was received) :(

According to the OP, his fiancee has already entered the US on her K1 visa. If they were legally married in Colombia then I'm not sure what there next step would be. You would assume they would have a marriage certificate from Colombia, but they couldn't use that to apply for AOS when they entered on a K1. In that case, I think they would have to abandon their K1 and pursue a K3 visa with his fiancee returning to Colombia. If they did not legally get married, then they should be able to have a court marriage, obtain a marriage certificate and apply for AOS with that. I would avoid mentioning their "unofficial" wedding ceremony at time of their interview though to avoid complications.

You can legally only mary someone once, unless the prior marriage ends through annulment or divorce.

The basis of any adjustment would be on marriage to a USC in the US evidenced by a marriage certificate.

You may well be able to get away with it in pracice, but if caught the ramifications would be nasty. Including perjury there would ba a long list.
