Dear Friends

I always find this forum a really helpful.

In past me and my fiance were getting information from this forum. We were to marry soon but some stupid laws of Ireland , we could not marry in Ireland.

I am in Ireland and she is in USA.

I want to know if someone can help. I am muslim and we do Nikah for marriage. if we both do Nikah and then apply for spouse visa, will it be ok or we must have to register with government and get a certificate from authorities.? Currently no muslim marriage is registerable with government.

Any Suggestions?

You will need a legal marriage in order to file a spouse visa petition.

As far as I know most US embassies required registered government certified marriage certificate. I believe you need to have it to process the spousal visa.

Although not muslim, maybe our experience might help?

Swedish hubby and I (US Cit.) married in Gibraltar, UK.

We had to

+ send in copies of paperwork ahead of time,

+ reserve a civil marriage with registrar ahead of time,

+ and show up 24 hour before the marriage in order for registrar office to check originals against the copies we had sent the month before.

Apostille'd marriage certificate was mailed to us in our respective countries about a month later b/c we didn't stay a week there to pick it up in person.

So - the USC could go to the UK to marry there civil marriage (do religious marriage later), or you file for a fiance visa and get married at any country registrar office here with the right paperwork. It takes about 15 minutes to be married in the office. Otherwise you won't have a legally recognized marriage license for the visa.

So - I think my suggestion is to get the civil marrigage first and then make sure you qualify for Nikan for cultural affirmation of marriage. :) best of luck M.

If the place where the marriage took place recognizes the marriage as valid, then it should be considered valid here in the U.S. You just have to submit other things to prove your marriage.

What do you mean by "Currently no muslim marriage is registerable with government."? Marriage is a marriage. Just fill out whatever form your government wants to get the marriage license if necessary.

What do you mean by "Currently no muslim marriage is registerable with government."? Marriage is a marriage. Just fill out whatever form your government wants to get the marriage license if necessary.

there are only three ways in ireland to get a certificate of a valid marriage. 1. marry in registrar office. 2. in church. 3 jews marriage system.

but currently no muslim marriage according to Muslim way , is recognised in ireland. we have to do in registrar office.

but due to some rediclous Irish laws I am unable to marry in registrar office.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

In Ireland I THINK... I THINK you have to register the intenet to marry 3 months ahead of time with the civil office. There is a form for that. Then you have 6 months to use the authorized form.

You could have civil registrar marry you civil-service way in about 5 minutes, then immediately do the do Nikah ceremony with witnesses. That would take about 3 minutes. Your witnesses will sign the civil form as well as your Nikah Nama. Then you are off to your Walima.

Quote about IRELAND: There are very strict regulations about who can be a solemniser, and in practice the list is comprised of either civil registrars and clergy of various religious bodies.

Location:

either the civil registrar's office (sometimes they have a nice room where they do it) OR another location.

Quote about locations for marriage: "the places which get approval are generally either churches, hotels and public buildings - NOT OUTSIDE"

NOTE: NONE of this will work if you are seeking a polygamous marriage, since neither of your domiciles recognizes that practice as legal.
