Timeline

Still haven't received my RFE that USCIS says they sent out on 6/24. I called today since they couldn't do anything about it until the 15 day mark. The gentleman said that he would send a service request out and I should hear from them by 7/26.(is there anyway to follow this request?) I asked how long I had to respond to the RFE and he said 30 days. I asked him how that was going to be possible since it had already been 17 (sat was the 15 day mark) and I still have to wait to receive the new one in the mail. Plus have time to get together what ever they are requesting.

USCIS said that if I don't send in what they need with in the 30 days my application would be denied.

Has anyone else ever ran into this problem? Is there anything I can do about the time frame?

Timeline

CSC has been very slow due to summer vacations. So you can expect the RFE in a couple of days. To just to let you know how slowly things are moving at CSC - CSC generally takes a week to 10 days to send the approved cases to NVC but are now taking around 25 - 30 days now.

Pars, RFE means Request For Evidence - when USCIS needs additional information regarding the I-130 application, they send out a RFE calling for those details.

USA

01/08/13 - Approved and GC is order for production on 1/8/14

09/12/13 - Case transferred to CSC. NOA2 received on 09/18/13

08/30/13 - Biometrics Done - No walk ins allowed at this LSC (received on 8/16/13).

08/05/13 - NOA1 (received on 08/10/13)

08/01/13 - Mailed I-751 (received on 8/2/13 - check cashed on 8/5/13)

12/28/11 - Received SSN (applied on 12/20/11, as we didn't get based on DS-230 options)

I don't mind at all :) . The problem is I haven't received anything at all from them so I have no clue what exactly they want. I am worried about the time frame.

What about the 30 day time frame to send back what they are requesting? That is what worries me the most. I can produce what ever evidence they are looking for just not sure I can get it to them in time.

May be call them and aks if the RFE has been dispatched or not. I don't have experience reagrding a RFE - I think it should be 30 days from the receipt of the letter. I will let someone who received an RFE to respond to you regarding this.

What is a RFE?

RFE stands for Request For Evidence. USCIS will send you a RFE when they need more information from you, such as missing or incomplete documents in your application. It doesn't mean your case will be denied or approved soon, although after long delays in security checks, a RFE may be a good sign that your case is moving again.

It is very important to respond to a RFE before the deadline. On June 18, 2007, new Flexible Response Times for RFE and NOID (Notice of Intent to Deny) took effect and they are now considerably shorter than the standard 3-month timeframe. So it is more important than ever to respond to a RFE/NOID before the deadline.

RFE and NOID Flexible Response Times Circumstance Standard Timeframe (calendar days)

To submit initial evidence that the form requires the applicant or petitioner to file 30

To submit evidence that Form I-539 (extension of stay or change in status) requires 30

To submit evidence available in the United States regardless of form type 42

To submit evidence available from overseas sources regardless of form type 84

I just hope I don't get denied due to the time frame. I don't see why I should considering I never received the document....but I also know that things do not work like that.

The funny thing is I wouldn't even have an idea that I received and RFE if I hadn't of called USCIS. My status online is still "initial review"

Based on what I read from this post reguarding the RFE.

If it was sent 6/24 you should already received it. I also think the Customer Service Rep was incorrect about 30 Days to respond or the Petition is Null and Void.

I know its a pain they won't tell you what the RFE is over the phone and you have to wait for Mail.

IF YOU HAVE'NT RECEIVED IT YET IN THE MAIL. Request that is LOST in the Mail and Not Received.

KEY NOTE: The RFE will have a Response Time for a Reply. " Carefully Open the Envelope and NOT TEAR the USPS Stamp which indicates the Delivery Date".

Well it sounded like he was going to have another one sent out...I thought. But the info pass appt sounds like a good idea. I have never done that so I am not sure how to get started on it.

NP :) Of course if they have issued a new one and you'll have received it before time runs out(look at "you're given until XX XX 2011" date on hardcopy when getting it) or infopass, make sure to cancel infopass. Infopass may be your plan B.

Its crazy they don't email RFE. You should send in complaint to ombudsman and suggest they make this change because of stuffe like this. They might also help you if you file a request with them.
