Greetings to all,

My approval letter was sent stating a date of june 17, 2011. I contacted the NVC to find out about my case, and they told me to send an email to NVCResearch@state.gov, along with a scanned copy of the I797 Notice of Action and the name and date of birth of both petitioner and beneficiary. I did that Thursday July 14, 2011. Since it has been way past the 15 business days. I also sent a similar email to NVCInquiry@state.gov on the same day. Today I finally got an answer from both the Research and the Inquiry email:

1st Email from Research:

Dear Sir/Madam:

The NVC recently received this petition. The appropriate agent

(applicant, petitioner, or attorney) will receive instructions for the

further processing of this petition within 6 to 8 weeks.

But just a few minutes ago I got this 2nd email from Inquiry:

Dear Sir/Madam:

Your inquiry has been received at the National Visa Center (NVC).

This petition is now eligible for further processing. The petitioner, principal applicant, and/or attorney of record will receive an instruction package regarding further processing of this petition.

The NVC does not have an overall processing time due to the fact that we cannot estimate how long it would take someone to accurately complete and submit the requested documentation. Once documentation is received at the NVC, the processing time for all documents to be reviewed is 2 to 4 weeks. Further information will be sent after the review is completed.

If a period of one year passes from the last date of contact with the NVC (by telephone, mail, or email), all submitted fees and documents will expire. If this occurs, your fees will need to be repaid and documents will need to be resubmitted in order to continue the immigration process.

Case Number: WAC1190*******

Petitioner's Name: KARLA

Principal Applicant's Name: SERVANDO

Preference Category: CR1

Your Priority Date: 24Feb2011

Foreign State Chargeability: MEXICO

AMERICAN CONSULATE GENERAL

PASEO DE LA VICTORIA #3650

FRACC PART SENECU, CD JUAREZ

CHIHUAHUA, MEXICO 32543

So I am guessing that in just a couple of weeks we will be getting our packet from the NVC to continue with the process.

noooooo! okay - first off: congrats on making it through to the other side!!!

second of all, don't "wait" for anything! call every day and by the end of 3 days or so,you should have NVC case number.

While you are on the phone with them, gettnig that case ID#, ask them for the Invoice ID and give them both of your email addresses.

Then immediately have beenficiary email over a DS-3032 email, naming you as Agent. That way you can pay for the IV and the AOS online.

Once those funds show as "clear" you can send the Affidavot of Supprt and the DS-230 which has to be filled in and signed by beneficiary.

If your spouse is in another country, get him/her to fil in Part1&2, sign part1, and dhl it to you pronto, b/c you could be sending it to NVC next week!!! Along with the DS-230 you have to include all original documents, and one set of photocopies. HEre is a link to the government web site listing the DS-230 instructions and the documents needed:

state department list of documents to include with DS-230

FYI:

Here's a new version of the story:

NVC operator kindly told me "it takes 2-4 weeks for them to forward the petitions,

and then 10-20 days for NVC to enter petition into the computer."

Then she said "Because it has been 15 days, please send scanned I-797 to NVCResearch..."

yeah, we all know how THAT goes. ;)

Your NOA2 is 6/27. Unfortunately the wait period between 6/14 NOA2 and 6/15 NOA2 was large - probably due to summer vacations kicked in at that time. However since the NVC case numbers started popping up, hope to get your NVC case number in 10 days time but send your email as suggested by NVC operator - you never know how they really start entering the cases into their system (FIFO (First In First Out) always doesn't work).

Also, While I got the first email stating that they didn't find the case, I didn't receive the second email that states that USCIS is in the process of sending it; unlike many others. Hence all I can say is do your deligence and hopr for the best.

Is that 10 days or 10 business days???? (kidding)

yeah - I guess it will be next week at the earliest, but... I hold onto hope that it will be this month.

I sent that I-797 to NVCResearch and NVCInquiry. They seem to come up with different results.

This morning I am hand-delivering my letter + Privacy Act Release form + I-797 to my representative.

They cannot speed things up, but I think they should know more about this process.

It's fee-based and yet we have no way to pursue consumer advocacy. It's like... dare I say: TAXATION WITHOUT REPRESENTATION!!!

I mean 10 days based on current situation. To be realistic I don't expect anything from the congressional representative now, as they are all busy with their battle - debt ceiling in Washington. But we need to do what we can.

I am hoping for my NVC case # this week. Hope keeps us going. All the best to all.
