According to the health department where i received my birth cert. in Washington state I was told a lot of government places will not accept a birth cert. that is 3 years old or older FYI

Whoever told you that probably didn't know what they were talking about. A certified birth certificate is a photocopy of the original document that was filled out and signed at the time of birth. That original document never changes, and a copy of that document produced today is no more or less reliable than a copy of that document produced 3 years ago or 50 years ago.

What should we do if the birth certificate of the petitioner is since 1975?

we request a new one but we cannot coz the MINNESOTA govt shut down so what should we do? this is one of the requirements in K1 visa :( Please can someone help me?thank you

The original birth certificate along with the 129-F? i arrange it already and at the same time we have a copy of his SS card and his passport front and back copies

No, not the original one. Just a copy of it. The one from 1975 is fine. They don't expire or anything. The certified copy someone's parents received at the time of the birth is still a certified copy, no matter how long ago they were born. Just don't send the only certified copy you have. Just make a copy of it and send that in.

im from texas, i used my birth certificate and its over 20 years old, so that should not be an issue

I don't think you need a new version of the birth cert if the old one is in decent enough condition to make a copy (mine from the 70s isn't). But, in MN you can also request a copy of your birth cert from the county you were born in (rather than from the state health dept). And I believe that county employees aren't state employees. You might want to call the county clerk to verify that before showing up.

Yeah and we print the front and back of his passport already thank youu sooo much :)

I'll go with Penguin_ie, a petitioner only has to prove US citizenship so even the US Passport pages will do that. No birth certificate of the petitioner required. If you don't have a US Passport you can get one pretty quickly if you are a USC. But I have to assume the petitioner has one already because they had to go overseas to meet their fiance! ;)
