Just got off the phone with DOS and Anna told me that all she see in the notes was it has been returned on the June 23rd because they don't believe in our relationship. She told me that thoes are the exact words they put in the system. :blink:

My question to her was why don't they believe? She said I have no idea... :wow:

I'm confused and I SO WISH I could get a stright forward answer... All I can do now is wait for USCIS... YAY!!!! :wacko:

@Atpeace We went over the papers, he told me every question they asked him and his answers all of which were right. the only thing I think is because in 2009 I never went to visit due to school and being unemployed, and I haven't gone there this year yet so that's all I can think of as lack of evidence other then that I don't have the slightest clue my fiance even said that he felt he was going to get approved he said the interviewer wasn't rude or anything.

So you did not provide evidence of meeting within the last two years?

Yes I went there twice before we filed for the I-129. Once in March and once in June, I didn't visit more because I wasn't employed and I was in school. Tickets from California to Jamaica are not cheap. They should not use that as a stipulation. But, now that I am working I can go more often.

Now you now what the problem was, so you can visit more before you get the NOID from USCIS, and appeal to them. But you will need documentation of the visits, i.e stamps in the passport and airline tickets.

They use it as a stipulation, because it's the only way they can validate real relationship as fraudulence ones. If you are truly engaged, you would want to spend as much time together, vs those who are being fraudulence about their relationships.

Phone calls are easy to do, but to go and spend quality time with someone you love, tellls a diferent story.

Sorry, but I wish the YARDIE thread was active, you would have hear this from the ones who have gone before you.

PS, I would be prepare to file another K1 with all of the new documents.

wow Kay i was really hoping for some quick good news for u guys :(...

well u already know my story and as i said before it has now been 6 months and counting and the last correspondence we got in jan 2011 from vsc said to give them 60 days to review...nothing since then...

we went ahead and got married becos we preferred to refile as married not fiance.we did not want to put our marriage on hold any longer. u were planning married in 3 months or so anyways so if u r going to refile i wud agree with refiling i130...

its pretty hard to get info from them when things like this happen and its a hard choice to make in just waiting or refiling.we contacted a lawyer in our matter and she said that she has seen many cases like that and that its faster to just refile similar advice also came from senator's office...

I still need to wait for a response from USCIS before I do anything tho right?

Instead of filing the 129f should I just file the 130?

I would do 2 visits before I refile, then I would file for a K1(129), a lot faster, I would continue to visit while I am waiting on my approval. I would wait out the 120 days, then I would cancel the K1 petition that was denied, before i RE-FILE A NEW ONE.

CONTINUTAION OF VISITS AND PHONE CALLS, MUST BE DOCUMENTED.

? did you provide evidence that the two of you were in the same place at the same time "evidence of meeting" within the last two calendar years?

July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.
