Hi guys,

Thank God i found this website and you can help me out.

Guys, my fiance is having interview very soon, my K-1 application just got approved, i gathered all documents she needs for the interview, and hopefully she will be here soon.

When she comes here, to USA, we're going to get married, and fill out all the papers for the adjustment of the status.

One of the forms is I-864.

Please clarify what do i have to include with this form?

3 years tax returns, recent pay stubs and a letter from the employer?

Here is the most important question:

All these 3 years income tax returns must be above the POVERTY GUIDELINES?

Or the MOST IMPORTANT THING IS HOW MUCH I'm CURRENTLY MAKING?

THe thing is that i just got a good job, and for previous 2 years i didn't make even 15000$, i make around 10000, which is way below the poverty guidelines. (I'm going to have 2 people in my household, Myself and my fiance, no dependents)

Another question is, what if 2 years ago, i filed my taxes as being a dependent person? I just gave my W2 form to my uncle and that's it, at that time I just immigrated to USA, and didnt know nothing about taxes refunds etc. SO should i include a tax income where i am a dependant and where my uncle filed it?

I believe you mean your K-1 petition was approved, and your fiancee will now be going to the interview for her K-1 visa application. An approved K-1 application would mean she already had the interview and was granted the visa. You should fill in your timeline.

At this stage you only need the I-134. Some consulates will only require the latest tax transcript. You should check with yours and find out if it would be acceptable to have only the most recent, plus your pay stubs and letter from your employer showing your current income to be above the 125% line.

When you eventually file for AOS, the I-864 will ask if you filed taxes for the last years, and to list the amount of your adjusted gross income from each of those years. Providing all 3 years worth of transcripts is optional. You are only required to supply the transcript for the most recent tax year. You will again supply your pay stubs and letter from employer to show your current income. If it is above the 125%, then you should have no problem.

What you are earning CURRENTLY is what matters. You have to at least have filed taxes for the last 3 years but only the most recent must be filed with the i-864.
