Unfortunately we got an RFE yesterday. I'm so upset! On the list the first thing they ask for as proof of valid marriage is birth certificate of child together - ####### that proves we have sex nothing more! We've been friggin' trying for over 2 years now, I've had one 8 week miscarriage as well as at least one if not two or three 4 week chemical pregnancies. I'm getting fertility treatments and everything!! The rest of the list is stuff we already submitted or stuff we don't have (ie a mortgage, credit cards together or loans). I'll be calling later today but I'm just so devastated! What happens if he's not approved?? He's deported? Or do we have other options (legal ones that is, we won't do anything illegal like overstay)?

first, it will get sorted out. fear not!

second, how is it possible for USCIS to ask for proof of a non existent-child? what (and i REALLY hope this is not the case) if you dont have children?

is that all they ask for?

have you got any new evidence (since you submitted the ROC)? more bank statements, paperwork from fertility treatments that indicate joint investment (emotional and financial)?

and remember that the RFE means that you case is currently being adjudicated, so once the RFE gets sorted, it will be not too long til you have the 10 yr GC in hand!

It's just the standard form that states ways to prove valid marriage. The first listed is birth certificate, then financial records, then residence.

I tried talking to them this morning but they have to either talk to my husband or he has to be on the phone with me when I talk to them, so will hopefully talk to them tonight.

I guess I can give them update info of everything that I already sent and maybe an affidavit from my OB/GYN regarding us trying to conceive.

so, I have not had a chance to let you all know but my approved letter finally arrived Tuesday in the mail. I actually got my letter first before the e-mail which was really funny, and as matter of fact I was already planning ahead for when July 24th came along and I did not have any kind of response from the uscis,(I had happened to call Monday to make sure that I can apply for citizenship with out the removal of conditions previously accepted, and there was no update on the case at least from what the operator told me) but as soon as my husband came in Tuesday with the mail we saw the noticed and seen that the date of approval was January 5 so, we were really happy to learn that, we can now relax. Now the citizenship boat I am not so sure we will be taking as soon as I am eligible just because its been a hard financially on us that we might wait, hopefully not too long, and I will get a passport along with my husband, since he's never had one we will go and apply together for one, at least that is our plan...

So, for now thank you all!! and GOOOD LUCK ON YOUR VISA JOURNEY!

I was hoping to check this thread and see SOMETHING for Vermont.... sigh.... so sad. Congrats to the others that have been approved though.

I'm so nervous about this whole thing... its been almost 6 months for us and no news...

there have been 11 may VSC approvals reported. (less than a quarter)

there have been NO june VSC approvals reported.

you shouldnt expect to see any july VSC approvals for a good 6 or 8 weeks.

When I called to check on my status today, they said they are still processing April 4th cases and to call back in 30-60 days. She also mentioned they received a lot of i-751 applications and they are going beyond their 6 month processing time (we already all know that!). The travel paper doesn't bother me, but this "pending" status has not only made an impact on my schooling, but also my driver's license, credit cards, etc. so annoying!

Baby girl: it shouldn't affect anything because u are considered a green card holders till they denie u. So u shouldn't have any problem. Especially with ur credit cards and driver license.

Am I the only one having a tough time? I was able to get credit card through Bank of America, but Tinker Federal Credit Union required I only have a pre-paid credit card due to my residency card expiring on Sept 29, 2009. My driver's license was only given to me the first time around for 2 years, I was only able to renew additional 1 year (the extension mentioned on my USCIS paperwork). Maybe it is the state of OK that initiates the driver's license rule. As for Credit Union's- you are right they are different from banks. The Nursing program at Oklahoma State University only gives you the license (which I have not yet completed) for the length of time you are in the U.S. Without the card stating 10 years, I won't be able to start the program.

Yea... I see that now... sucks. Specially since you have no idea if you're gonna get an RFE like 9 months after you send in the paperwork... :/
