Ok, So I've been looking through posts for the last couple days. I feel like a complete idiot because I can't figure out what's going on. Can someone please explain the whole IMBRA thing to me? I'm still waiting for my fiance to send her bio papers so I haven't actually begun the process(I'll be going through CSC) I have no criminal record. Is there anything I need to know before I send my papers? Will the "IMBRA thing" affect me?

I just sent my I-129F in about a week and a half ago. From what I was told about the IMBRA is that on the old forms there was no question about if you met your SO through a marriage broker. On the new forms there is and I am sure you remember answering the question. This is why all the people that sent theirs in earlier this year got the RFE's about the IMBRA. That was my understanding. I am sure other people understand it more then me so I will be interested in what others say to. I wish you the best.

The 'IMBRA thing' will affect you in terms of CSC still working on their backlogged files, and generally being slower than Vermont Service Center anyway. But your actual case won't be affected because you will be using the newest form.

mgleason, matt and ready4one's comments were right on target.

The IMBRA law went into effect on March 6 but USCIS didn't update the I-129F with the necessary questions to comply with IMBRA until June. For that reason, all applications were pretty much on hold until an RFE was created and sent out to all petitioners who used the old form. Once they were returned, processing restarted but they lost several months (that's why it took many of us 5+ months instead of 2 or 3 to get approved).

As long as you used the new form, the only impact you will feel is the lingering delay while they clean up the mess. Otherwise, you should be fine and hopefully will not endure a long wait!

Did you use an internet website to meet your SO? If you did, then IMBRA will affect you too.

Negative, This is not the case always only if they met through a marriage brokerage.

There are differant types of online dating and meeting web sites that are not considerd marriage brokers.

At this point, everyone is affected by IMBRA, in the sense they have to comply with IMBRA requirements, if you fall under it's law. Either way you must use the new form I-129F that contains the IMBRA related questions, and must file a waiver in case you've filed an I-129F twice before.

Technically speaking, everyone has to comply with IMBRA; it's that 'complying' in many cases means 'check 'no' on question 19.'

Otherwise, as people said, in most cases it means a short delay due to cleaning up backlog; in other cases I'm not quite sure what it means, delay-wise, but the U.S.C. will have to provide police records if they've commited certain crimes. The instructions come with the forms.

I was also really worried about this, but I filed in Mid May, on the site it states the new i-129f was made available to the public on June 15th 2006 USCIS will accept older versions of the i-129f 30 days after the 15th June 2006, therefore all filings after July 15th 2006 on old forms must be rejected.. if you all knew this already sorry about that, I just discovered it!

This piece is actually good news for someone who filed with the incorrect form after July 15 -- it means USCIS will simply return the entire packet and the filer can start over with the right form instead of waiting for months to receive an IMBRA RFE!

If you filed with the old form (which you did because the new one wasn't available in May) you will receive an RFE. Every petitioner has to comply with IMBRA by answering the questions on the RFE (or the new form) - no way to avoid it.

Ah the disbelief - that's what everyone who filed in March and April went through. Hard to comprehend that they passed a law in January, enacted it in March, and didn't provide the correct form for filers until June. They didn't even contact petitioners to tell them what was going on. That's why we all went crazy sitting around for months waiting for them to create the RFE and send it out. Most of us lost months during this time (some were luckier than others and some March filers are actually still waiting for RFEs)

Unfortunately, such is USCIS.

Not sure what the RFE security info questions were - maybe you can compare and see if they are one and the same?

Unfortunately, nothing to be done until the IMBRA RFE is received.
