Hey i have a question about how important the pay stubs are? Will the tax records be sufficient enough?

My husband is unembloyed, has been for a long time. We are going to use his fathers (who is a household member) and his brothers income as affidavit. The broblem is that they are bouth selfemloyed as oil pipeline welders. They make a lot of money out of it during a year. Now they been on a longer holiday home and have just gone back to working and therefore they don't have any paystubs to show at the moment since they have not yeat received any pay.

I was wondering if we should wait (in agony) for them to get some paystubs or would it be ok to send just the tax returns and all the assets information they have?

my husband is a selemployed too ,we're not sending any paystubs...he doesnt have em, he is sending copy of 1040 thats it

and we will see if we get a RFE hopefully not

The instructions say if you are self employed, check box 22b...one of the following forms should have been filed with their 1040: Schedule C, D, E or F. One of these must be attached to 1040. This would be enough, no paystubs needed when self employed. Some people get a letter from employer instead of using paystubs, they are just one option of proving current employment. If they have been in business for a few years, you may want to include prior years tax returns with all schedules attached, to show steady income.

What is this 1040? is it some extra part for the I-864? Or do they need to fill a totaly different affidavit of support because they are self employed.

And thanks for the help.

It's hard for them to get a letter from the employer too because they are employed by different people every few months. So it doesn't really show a stable job status.

A self employed person uses the income amount shown on line 22 on their most recent form 1040 tax return. In this case their 2010 tax return.

The father and the brother cannot combine incomes as joint sponsors. Either the father or the brother must show enough income individually to cover their household plus the intending immigrant.

Ok so the 1040 is just the number code for a tax return.

So does it mean that it doesn't really help to have them bouth as co-sponsors? Since they can't be joint sponsors? Should we try get someone else that is not a household member to joint whit his brother instead of having his father as a co-sponsor too?

Sorry for all these guestions. I just want to be sure we doing this right and it will work. And i'm bit slow at getting this >_>

The self-employed don't have "pay stubs" from an employer, even though they may be paid by check. The self employed state their current income from line 22 of their 2010 tax returns and need only provide a complete 2010 tax return as evidence of income. Three returns would be better. You only need one qualified joint sponsor so pick one, not both.

I don't know if they look at age, but if your BIL has a larger family (4+) then I would go with your father-in-law. Remember, your joint sponsor has to make at least 125% above the poverty line for the size of the family. The larger the family, the higher the minimum threshold.

You can't have them both. Pick the one most willing.
