As Nick-Nick explained, booster shots are not required for AOS, but flu shots may be required for filers after October 1st.

I passed my medical and interview and my medical form is checked as incomplete with an explanation that I did not get the flu shot because it wasn't in season yet. Do I have to get it at a USCIS approved civil surgeon down in the States or can I get the flu shot up here in Canada with a sheet confirming that I had it done? The situation with this dumb vaccine that I get every year anyway has had me confused for months.

First, a big disclaimer: I'm only expressing my own opinion and what I learned at VJ and what I did for my wife's AOS package.

I feel it's important to understand what you have in terms of documentation and hope the USCIS officer use some common sense.

I assume you have a DS-3025? I don't know what else the Canadian medical facility provided, but in China my wife got a DS-3025 in a seal envelop addressed "USCIS Vaccination", a copy of the DS-3025 with her Chinese physician's signature and the "incomplete" and "waiver" boxes checked, and a yellow booklet with her vaccination records. I made copies of all those and mailed them with her AOS package. If you're still in Canada you may consider going back to the USCIS authorized medical facility to ask for a sealed envelop with a copy of your DS-3025 for AOS purposes? My wife asked when given the envelop and the Chinese nurse told her the sealed envelop contains an official copy of her DS-3025 for AOS filing.

I don't know much about the flu shot since we filed before October. Hopefully someone who filed in October and November can shed some light.

I for one would try to avoid a US Civil Surgeon and the I-693 if I can. I would go ahead and submit what I have, that is DS-3025, and if the USCIS issues me a RFE for flu shot, then I'll send proof of the flu shot. I'd go by what the RFE asks for. Only if it asks for an I-693 will I go see a Civil Surgeon. Some AOS cases with RFE went as quickly as those without, so it really depends on a number of factors.

I'd just do the best I can and hope for the best :)

Please do not take this as an advice for how you should prepare your package although this is what I did for my wife's AOS :)

Thanks for your advice, bobbyA. I do have the DS-3025 with the waiver boxes checked. I read that some people had to go to the civil surgeon and others didn't. Sounds like if I got the DS-3025 I can file AOS without having to trek out to a civil surgeon so I'll head that route so long as an RFE we might receive won't set us back by months at a time.

Last night I received an email from USCIS..."On November 16, 2011, we mailed you a notice that we have approved this I131 APPLICATION FOR USCIS TRAVEL DOCUMENT. Please follow any instructions on the notice". A bit confused since I have not done biometrics yet...so on the bright side I imagine that it will go to production soon after my biometrics appointment? And since work/travel are now a combo card will I have work authorization too???

Enjoy your day!

Bobby,

Guess what I got an email about today..."On November 21, 2011, we transferred this case I485....to another office for processing.."

My RFE did not seem to delay things too long. I will be so happy not to feel 'confined' to living in the USA and be free to travel back to Canada.

Has your wife received anything else from USCIS lately? How has she adjusted to life in the USA? I have not regrets but sure miss my girls and grandchildren!

Have a wonderful Thanksgiving on Thursday,

Lise

Lise,

Congratulations and thank you for sharing your good news!! Very happy for you!! :)

Yes, it looks like your application's moving along just fine, got your AP approved last week and now your I-485 transferred!! What a great way to start/celebrate Thanksgiving week!

Besides getting her biometrics done and I-485 transferred to CSC, we have not heard anything since the last email/update on 10/27 that her I-485 "is now being processed at a USCIS office".

Thanks for asking how she's doing. She's doing just fine, although sometimes feeling a little lonely. Lonely because she came from China where there are lots of people to "small town USA" with relatively few people :D Things/people/buildings are spread out here and she can hardly see anyone during the day. She can't drive at the moment, so she's kinda trapped in the house although shops are just a 3-minute drive away but 30 to 40-minute walk away. She walked to the store once and I told her I don't like the idea of her walking out there alone, so she has no choice but to wait till I get home to chauffeur her.

Although she attended driver's ed class, she can't even take her driver's written test without her EAD. She was kind of disappointed after studying so hard for the test to be told by the DPS officer, "I'm sorry but we can't let you take the test at this time, please come back when you have your green card or EAD" :(

However, she is one industrious lady eager to learn and explore. She's never baked a cake in her life in China, but she learned to do so here, and even made pizza from scratch!! :D Thanks to the internet, she's quite a domestic engineer now!! :D I've gained about 4 pounds since she arrived less than 3 months ago, that's because I'm eating better and having to do less housework :D She manages to maintain her weight because she's quite conscious and careful about it.

She's been reading up on TOEFL exam in preparation for the possibility that she might enroll at a university, mainly to improve her English she says. She got me to take her to a nearby church and found a small lady's group of her age group that meets every Thursday afternoon. The group leader is very nice and gives her rides.

We bought an electric piano couple of weeks ago, and she's learning to play the piano now :D She is one determined lady, keeping the house clean while learning a few new skills.

Like you, she misses her daughter, and we plan on her going to China next Summer or Fall. In the meantime, she's adjusting quite well in general.

We wish you and your family a wonderful Thanksgiving as well!! :)
