Hi,

I am in the process of getting my packet ready to turn in for the petition for a K-1 visa for my fiance from Algeria. It states in the I-129F section of proof of having a relationship, that proof should show that the two of you have met in the last two years. I do not have airline ticket stubs. I just realized that my last entry date into Algeria is not stamped clearly in my passport, and this stamp is a large part of my proof that I was in the country. However I do have a clear stamp from Canada on my way to Algeria, and an itinerary. The second part of this problem is that it has been almost 2 years since I have seen my fiance. My question is does USCIS judge the two year period of proof from the last date of entry on my visa? or my last exit out of Algeria which was in August. The other part of the question is do they judge the two year period from visa stamp of entry/exit, or from the date that they receive the petition? Please help if you can...I am running out of time!

p.s. i do have pictures of us together, emails, instant messages, etc.

Thanks so much

You must show primary and secondary evidence that you have met in person with your fiancee within two years of filing the petition. They go by the NOA1 date. Send what you have, explain if necessary in a separate sheet.

Thanks, unfortunately I didn't use my ATM card...I was unable to use it in the area in which I stayed, but I do have many photos, instant messages, pictures of gifts, etc.

After searching, I'm not sure what the NOA1 date actually means. It appears that it is confirmation that your packet has been received. I'm not sure how this would factor into the 2 year period of proof of having met one another, as it would seem you have two years from the date of entering or exiting the country....but I have no idea.

The day USCIS accepts the petition they will issue a Notice Of Action (NOA) informing you that your petition has been accepted. This is frequently the day it's received or the following day - whenever someone has had a chance to review it and determine if it's got the right forms and payment, put it in a binder, and drop it in a box to await adjudication. This is usually within a week or so of when you send the petition, depending on what delivery method you use. This first NOA is referred to as "NOA1" on this site.

Count backwards exactly two years from the NOA1 date. You need evidence to prove you and your fiance were together sometime within that two year window. As long as you have primary evidence with a date sometime within that two years then you should be ok.
