6 months WAITING- need opinions please

Timeline

Hi friends,

Here are some details of my case:

-I was married to my USC wife last June 2010.

-We filled all the requirements Oct 22.

-Got NOA Oct 28.

-F1 status expired Dec 4.

-Biometrics Dec 9.

-Got my EAD card Jan 7.

Now, I am still waiting for an interview date. Every time I got USCIS website and check the status of my application it says: (1) initial review for I-130 application; and (2) YOUR APPLICATION CANNOT BE FOUND for I-485. I called USCIS twice already and at both instances they told me that there is something wrong with their website/system but my application is in order and is still in review.

***In the light of all the factors, should I be worried that I haven't gotten an interview date yet when I filed in October?

***Was the fact that my F1 status expired a big issue?

*** What can I do at this point?

***Anyone familiar with the timeline for cases like mine in NYC?

NYC seems to take forever with interview appointments, much longer than other locations. So I wouldn't start worrying yet.. You have your EAD, so you are OK to work. If you got an AP too, you are OK to travel. Your F1 expiring doesn't matter in this situation, since you are authorized to be in the US while they are processing your AOS application, so you don't need to worry about that.

It sucks to wait - but that's all you can do, really. And over 6 months waiting for interview doesn't seem to be uncommon in NYC.

03/21/2011 - Day 18 - Biometrics letter received, biometrics scheduled for 04/14/2011

03/31/2011 - Day 28 - Successful walk-in biometrics done

05/12/2011 - Day 70 - EAD Arrived, issued on 05/02

06/14/2011 - Day 103 - E-mail notice: Interview letter mailed, interview scheduled for July 20th

07/20/2011 - Day 139 - Interview at Federal Plaza USCIS location

07/22/2011 - Day 141 - E-mail approval notice received (Card production)

07/27/2011 - Day 146 - 2nd Card Production Email received

07/28/2011 - Day 147 - Post-Decision Activity Email from USCIS

08/04/2011 - Day 154 - Husband returns home from abroad; Welcome Letter and GC have arrived in the mail

("Resident since" date on the GC is 07/20/2011

Did they cash the check for the I-485? When you did your finger printing and picture, was it for both I-485 and I-765 the EAD card? Just curious because our time line is pretty close but my case is in Los Angeles. If you filed an I-485 and I-130 at the same time I would not travel out of the country even if you have an AP, my lawyer advised me of this.

If they have AP they can travel as long as there is not 180 days of overstay, which in the OP's case is true (F-1 visa expired AFTER AOS was submitted). You may have overstay, which is why your lawyer advised not to travel. AP is fine to use - no scare tactics please. We used AP just fine, just like so many others.

Hello,

yeah... it seems that a lot of people are waiting for a long period of time in NYC.

can you please post in the thread that was specifically made for NYC filers? it gives everyone who is in the same boat a general idea of what is going on.

On a side note... My wife knows of a couple whom she is friends with now that filed in November and already have their GC. So I think some individuals are very fortunate to go through this process quicker while the majority of us are still waiting.

I would wait until their next update and then ask for service request.

8/5/11 - Interview letter mailed
9/8/11 - Interview @9am
9/9/11 - Card Production
9/20/11 - Received Green Card

7/2013 - Submitted Removal of Condition

9/2013 - Biometrics Completed

11/20/2013 - NOA1 - Request for Evidence

12/20/2013 - RFE returned

1/2014 - 10 year green card approved.
