Hi,

I have been reading for weeks and have no idea where to start this topic or which direction to go so i apologize if this is the wrong forum for this please just help ...

Quick background

Have been video conferencing and chatting with my boyfriend for 3 years we have never met (number of reasons as to why)

I am now planning on leaving to live and marry him in the states .. I am Canadian..... I also have a 10 year old son...

He recently got an amazing job offer and that is why our plans have shifted to this and because of this we have decided to move there ..

We were thinking of moving there this summer getting married and applying for status BUT my biggest concern my son needs to be able to attend school and I am also wondering if this is a bad decision.

The other option is he come here in june for his 1 week off he will have till next year and we get married he goes back and we do the whole apply and wait it out .. I live on the very eastern part of Canada and the closest consulate is mid Canada so traveling there for interviews and what not scares me as well this is why we rather the first option and get this train on the road 3 years is enough waiting for everything to be in place and everyone done school !

Oh I have never been married and have never committed any crimes ever nor do I do drugs or drink.

please please please any insight would be greatly appreciated :)

To come and marry him in the US and then adjust status to LPR, you need the K-1 fiance visa. You would apply for that, and once approved, enter as K1. You would then have 90 days to get married in the United States, and then file for AOS for legal permanent residency.

However, I believe one requirement of a K1 is that you have seen each other physically at least once within the past 2 years. It also takes several months for it to be approved.

The other option is for you to come here / him to come there and get married, and then you stay in Canada / return to Canada and file for the CR-1 option. I believe this is both cheaper and faster of these two options.

I am not aware of the forms that need to be filled out with each petition for your son, but I am sure someone will jump in shortly to advice on that. In the mean time, I would start reading the K-1 and CR-1 guides here on VJ.

03/21/2011 - Day 18 - Biometrics letter received, biometrics scheduled for 04/14/2011

03/31/2011 - Day 28 - Successful walk-in biometrics done

05/12/2011 - Day 70 - EAD Arrived, issued on 05/02

06/14/2011 - Day 103 - E-mail notice: Interview letter mailed, interview scheduled for July 20th

07/20/2011 - Day 139 - Interview at Federal Plaza USCIS location

07/22/2011 - Day 141 - E-mail approval notice received (Card production)

07/27/2011 - Day 146 - 2nd Card Production Email received

07/28/2011 - Day 147 - Post-Decision Activity Email from USCIS

08/04/2011 - Day 154 - Husband returns home from abroad; Welcome Letter and GC have arrived in the mail

("Resident since" date on the GC is 07/20/2011

Agree with other posters that you should visit in-person first before making decisions.

Mrs.Finland-USA is correct, to be eligible for a K1, you must have met in-person at least once two years prior to filing the I-129F.

August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!

Correction. at least once WITHIN THE two years prior to filing teh I-129F.
