Hello everybody! I just discovered this website and i would like a few advices about my case.

My story short: i came to USA in 2006 with H2B visa. I overstayed unfortunately. 2 weeks ago i married my boyfriend of 3 years -we eloped to Vegas for my bday.

I would like to start the AOS process. I dont know if i should try to do it without a lawyer?

And does anyone know a reliable lawyer who can help me?( i live in California)

The guides here are great! If the only problem in your case is that you have an overstay than you most likely do not require a lawyer. Look over the info and see if you feel comfortable with it. Feel free to get consultations from lawyers though.

Congrats to you newlyweds !! :)

..and welcome to Visajourney. You don't have to worry about the overstay as AOS based on marriage to a US Citizen. overstay, working without a work permit EAD is forgiven with that.

I can tell you from my own experience that I have been out of status for some time due to my first marriage didn't work out but fortunately found true love and was able to also file for AOS several years after my visa initially expired and got my green card approved.

As far as the lawyer goes, if you only have a question here and there, you can always get a consultation with a legal council and their business, but you can also check out your community for non-profits that assist with immigration matters. I received valuable advice from an immigration attorney at a legal immigration clinic of Catholic Charities, though I am, it doesn't matter what religion you have if any.

10/13/2010 - Mailed in The Package (AOS, I-765, I-130)

10/17/2010 - USPS confirms delivery to USCIS

10/25/2010 - Check cashed

10/26/2010 - All applications been worked on aka touched

10/28/2010 - NOA1 Receipts for applications received

11/24/2010 - Received appointment for biometrics in the mail for 12/17 *yay*

12/17/2010 - 9.25 a.m. - 9.45 a.m. Biometrics done !!

12/23/2010 - EAD Approved and Card on its way - Email notification received *yay*

01/03/2011 - WOOOHOOO ...EAD Card in Hand!

01/04/2011 - Oh boy....Received Interview Letter today - February 3rd is the day! :)

02/03/2011 - Interview scheduled 12:45 p.m. - out of there before 1:30 p.m. - further review

Coming home, checking for touches at 5:30 p.m. - CARD PRODUCTION ORDERED !!!!

02/09/2011 - Yup another e-mail saying that my card production was ordered.

02/10/2011 - E-mail notification "Approval letter was sent today"

02/14/2011 - Welcome Letter / Approval NOA and Card (separate envelope) received!!! :D

Late November 2012 (have to look up my receipts ;) - mailed in ROC I-751

12/12/2012 - NOA 1, status extension received

12/18/2012 - Biometrics appointment letter received

01/08/2013 - Biometrics done

Just an FYI... you should read and post in this forum: http://www.visajourney.com/forums/forum/130-adjustment-of-status-from-work-student-tourist-visas/ as you are AOSing from a H1B visa. Everyone in that forum file the I-130 like you will and of course other people AOSing from a H1B like you.

Just like what they said, follow the guides and links they provided you. File for AOS as soon as you can. Do NOT leave the USA until you get your GC. Don't do anything that would attrack attention of any LEO (don't do shouting match with your husband as your neighbor might call LEO thinking it's a domestic violence, don't do DUI, don't do DWI, don't pick a fight with anyone, just do a low profile).

I had the same dillema whether I should get a lawyer I overstayed on my visa for about 10 yrs, went to consult a few lawyer they told me my case was very easy and not complicated as I thought, I did sent my aos package without a lawyer and spent a lot of time in this forum looking for answers and got my aos form and filled it all out along with i130 , yesterday I got my noa1, its up to u if u want to get a lawyer but I suggest consult to one so u can see what they will tell u, if ur case is good or not u can ask them about overstayed, thats first thing I said and they told me they are forgiven once married to a usc and if u entered the country legally
