I'm trying to get a better idea on how much longer it will be until my husband is able to come to the United States. This is what we have done so far:

1. Got Married in June of 2010

2. Filed I-130 in August

3. Then I filed an I-129f because I was told it would help me have him here sooner

4. Now I've gotten mutliple transfer notices saying that they are being transferred from one center to another, etc

5. But my ultimate question is.......will the I-129f that I filed delay the processing time for my I-130?

Its already been 8 months since I filed and haven't gotten a decision yet. The USCIS website said that processing time is 5 months. Can anyone tell me what to expect?

I-129 is a fiancee visa, there was no reason to fill this out if you did the I-130...This could confuse USCIS.. I would call them and see what is going on.. You sent I-129 by mistake

Yep, you belong to July/Aug. refugees thread, we all came a long way and almost all of us are @ the NVC stage after 7-8 months waiting for aproval...

I am just curious, did you get any kind of notice until March 1st?!? They made it public that they must do something until that date (notice of aproval, RFE....)

USCIS journey:

02/11/2010 - got married

06/28/2010 - sent I-130

06/29/2010 - received by uscis

07/06/2010 - notice NOA1

07/08/2010 - updated

07/10/2010 - got NOA1 hard copy in the mail

11/01/2010 - moved from CSC to TSC

11/02/2010 - updated

11/03/2010 - updated

11/23/2010 - updated (post decision activity)

02/09/2011 - notification moved from TSC (back to initial review :o )

02/10/2011 - confirmation TSC back to CSC!

02/16/2011 - APROVED!!!!!

NVC journey:

02/25/2011 - we're IN :)) case # Emailed DS 3032. Paid AOS Fee.

03/01/2011 - DS 3032 approved (confirmation by email)

03/02/2011 - AOS shows paied -> AOS packet mailed out

03/04/2011 - AOS received

03/07/2011 - IV generated & paid

03/09/2011 - IV paid! mailed out->

03/14/2011 - IV received

03/31/2011 - Case complete @ NVC!!!

I guess they were after K3 when filed for I129(and than follow the AOS + AP + the rest) .....hmm.....since they filed in Aug. the CR1 should be granted by now. I think I129f it's for K1, I 129 it's for spouse

5. yes.

what to expect -

the I-129F and the I-130 were joined up at USCIS, and will be approved on the same day.

Then they'll be sent out to NVC -

and NVC will administratively close the I-129F, as it's basis for any future K-3, an unapproved I-130 petition, doesn't exist .

Then - expect to do NVC processing, perhaps even MEXICO Electronic Processing (MEP).

I-129f used to be used to speed up the process and give you a K3 spousal visa but that doesn't work any more now but that's certainly not the reason your case is not adjudicated for 8 months

You should call USCIS and ask them what's the hold up

I wouldn't be concerned about the I129 at this point!They are 8 months since they filed the I130!! I would be after the I 130.... they said by March1st, right?!

Ohh, and ...5 months it's kind of "wishful hopeing" as some of us learnt just by being in the July/Aug./ multi transfer+ multi delays+++camp :D

The above is wrong. The I-129F is also used as a second petition in spouse cases, intended to follow through to a K3 spouse visa. It doesn't work anymore but it will not confuse USCIS.

Facts are cheap...knowing how to use them is precious...

The question is not "will it...?" but "has it...? and the answer is yes. Filing the I-129F took your I-130 out of its place in line and put them both back whatever period of time between the two filings. Ultimately the I-129F will be closed administratively by the National Visa Center when it and the I-130 approved on the same day, arrive at NVC together.
