Hello Vjers,

Im wondering if getting an immigration lawyer would be the right way to go to get a fiance visa from the Dominican Republic. Has anyone gone with an immigration lawywer before? If yes, about roughly how much do they charge and was it easier? I want to begin my fiance visa process and I was told that its difficult to get my fiance from Dominican Rep. to the US and that it would be better to get an immigration lawyer. Please help, this is my first time doing this and I don't want to get denied.

Thank you,

Cristy

The advice you will get on a do it yourself board will be that you don't need a lawyer if you have a straightforward case, and I would agree. No overstays, drug use, previous petitions you most likely can do as good of a job or better than any lawyer plus save yourself several thousands of dollars.

Which of the following told you that you should hire a lawyer?

1. An immigration lawyer.

2. Someone who has never gone through the family immigration process before.

3. Someone who has gone through the family immigration process, but doesn't personally know anything about it and always depended on a lawyer to do everything for them.

This isn't a legal process. There are no courts or judges involved. The process is part bureaucratic and part uniquely subjective. The bureaucratic part can be handled by submitting the required forms, properly filled out, accompanied by the required evidence. The uniquely subjective part comes at the consulate, where only someone with specific experience with that particular consulate will be able to help you maximize your chances of success.

If you have sufficient free time to study, and are of average intelligence, and don't have any serious complications in your case (criminal convictions or past immigration violations, etc.) then you can do this yourself. Everything you need to know is here on this site.

I talked with several lawyers prior to submitting my K1 Visa petition. One lawyer was pretty bitter; called the USCIS a bunch of "scumbags" and wanted about $1900 dollars for the K1 petition. The second lawyer was a scumbag himself. He tried to make sure that I exceeded the 30 minute free consultation time limit and tried to scare me into using him (horror stories about 3+ year petitions and guaranteeing that my petition would go through within 5 months if I used him). He also wanted around $1900 for the K1 application (Los Angeles prices). Both left a bad taste in my mouth, so if you hire one, be sure to check out their credentials and make sure you feel comfortable with them.

After spending some time on VJ to collect all the needed information and reading people's post on K1 petitions, I decided to apply myself. No biggie, you just have to be a bit thorough and systematic. All the information you need is here. It was definitively a good decision for me not to use a lawyer, but then again, our petition was a straight forward (knew each other for almost 7 years, lived together for 3 years, ...). Our application from NOA1 to Visa issue was 186 days. There is no way a lawyer would have been able to do anything faster or better. I'll definitely NOT use an attorney for the AOS. Waste of money in my opinion.

Some food for thought... a friend of mine did the K1 petition himself and had a paralegal with immigration experience review it prior to sending it in. The cost was $300 and the paralegal was super nice.

Best of luck.
