I have a question regarding the income requirements for the I-864.

I recently started a new job the exceed the income requirements for me and my family. I started the job in Aug 2010. Prior to that I was unemployed for quite some time, and i don't quite meet the requirements based on my tax return for 2010. Will I be okay? Or will they look at this past year and disqualify me?

You are applying for AOS? from K1 yes? If you don't meet the requirements then yes yu will need a co sponsor or you can write on separate piece of paper explaining your job now and get a letter from your employer detailing your annual income for this year and what you have earned from when you started.You will be filing 2010 tax return now yes? it will show your income on 1040.You only need to show previous year tax return.

Thanks for your reply, my new income well exceeds the income requirements by m ore than $25K, but I was unemployed for more than 20 months, and my 2009 and 2010 income comes close to the requirement, but does not exceed it. I can show verification of employment easily as I now work in a goevernment job.

My 2010 will not exceed the requirement because I did not start the new job until August 2010. Will they not consider the fact that my income will be fine in the future?

My question is, that if my 2010 tax return Adjust Gross Income does not meet the Poverty Guidelines for my household size, but my current income now well exceeds the Fed Pov Guidelines, will I still be disqualified. I can clearly show from my employer that my income is fine. But I was receiving unemployment for most of the 2010 year. We dont have a cosponsor option right now.

My question is, that if my 2010 tax return Adjust Gross Income does not meet the Poverty Guidelines for my household size, but my current income now well exceeds the Fed Pov Guidelines, will I still be disqualified. I can clearly show from my employer that my income is fine. But I was receiving unemployment for most of the 2010 year. We dont have a cosponsor option right now.

Write your current annualized income on the I-864; i.e., how much you'll make if you continue to receive the same pay for the entire year. Get a letter of employment, on your employer's company letterhead stationary, stating when you were hired and how much you currently earn. Provide some paystubs to verify your wages. You'll still need to include at least a 2009 tax return, or 2010 if you've already filed it.

Current income is what counts. You've been on your current job for roughly six months, which should be more than enough. They don't usually kick about your tax return total income if your current income is more than enough unless you're self-employed.

BTW, "Adjusted Gross Income" is only considered if you filed a 1040EZ. If you filed a 1040 or 1040A then they use "Total Income".

You may qualify on your own based on your current employment. Include a letter from your employer as proof of current job. Worst that can happen is an RFE for a co-sponsor. Good luck.
