BREAKING: Florida judge strikes down parts of health care reform

(CNN) - A federal judge in Florida has struck down key parts of the sweeping health care reform bill championed by President Barack Obama as unconstitutional. Officials in Florida and 25 other states are challenging sections of the Patient Protection and Affordable Care Act, including the "individual mandate" requiring most American to purchase health insurance in four years, or face stiff penalties.

Florida Judge Voids Entire Health Care Law

A federal district court judge in Florida ruled today that a key provision in the new health care law is unconstitutional, and that the entire law must be voided.

Roger Vinson, a Ronald Reagan appointee, agreed with the 26 state-government plaintiffs that Congress exceeded its authority by passing a law penalizing individuals who do not have health insurance.

"I must reluctantly conclude that Congress exceeded the bounds of its authority in passing the Act with the individual mandate," Vinson writes. "Because the individual mandate is unconstitutional and not severable, the entire Act must be declared void."

Yup. By SCOTUS' own ruling in Clinton vs. New York that eliminated the line-item veto, that makes what he said true. Rudy's lawsuit did so much to harm our system that things like this have to happen. It's the same with the campaign finance ruling back last year that got libs in a grumpy mood...

If people would stop and 'think' about legislation before passing it, we wouldn't have scenarios like this.

Yup. By SCOTUS' own ruling in Clinton vs. New York that eliminated the line-item veto, that makes what he said true. Rudy's lawsuit did so much to harm our system that things like this have to happen. It's the same with the campaign finance ruling back last year that got libs in a grumpy mood...

If people would stop and 'think' about legislation before passing it, we wouldn't have scenarios like this.

Good, declare the whole thing void and pass single payer. It's to bad we won't get that from the new congress. Obama and the dems blew the one chance we had to get SP. They should all be held in contempt for their stupidity.

If the country really wants the Gov't taking over the healthcare industry and controlling the people who use it..... why would that have been the "one (and only) chance"?

I don't know, you tell me. I only know there is a zero chance of the reps putting together and passing a SP system. Only a fool would think we can continue with the way things are now and the "reform" we just got only made it worse. IMO the only thing worse than the idiot reps being unwilling to go along with SP are the moronic dems that wasted our one chance. I have no use for either of them.

Don't panic. Remember, the individual insurance mandate was originally a Republican idea, way back when Clinton was trying to get a healthcare bill passed. So far, the score 2-2. Two Democratically appointed judges threw out the lawsuits while two Republican appointees have ruled it unconstitutional. Even conservative legal experts have stated that the individual mandate is well within the jurisdiction of Congress. All of these state level rulings don't mean much as it will be the Supreme Court that ends up making the final decision and that may be years from now since the affordable healthcare act won't be full implemented until then.

How can you call it 2-2? The clinton version of healthcare insurance was a poor effort. This bill currently is a poor effort. The only other option is to go back to a horrible, corporate profit driven system. So I suppose by my count, it would be Corporate America 3, American Citizens 0.
