Fastest processing time for F2A spouse

Hi all,

I recently submitted the i130 in Jan,2011 and got the receipt in a week.

Would like to know what's the best case scenario for my spouse to come here.

This is what I'm hoping:

1. 01/2011 i-130 submitted

2. 06/2011 i-130 approved (est. 5 months)

3. 07/2011 NVC received case and assign Case #

4. 09/2011 Case completed

5. 10/2011 Schedule interview

6. 11/2011 Visa received

7. 12/2011 Arrive in USA

Assumption : PD is current during step 2 to step 5. (I know it's unlikely...but we can hope)

Some more questions :

1) If PD is still not current when my i130 is approved, will my case still get transferred to NVC

and wait for PD to be current? i.e. idling at step 3?

2) Must the PD be current through step 3 to step 5?

i.e. If PD is somehow retrogress again after NVC complete the case,

I'd still have to wait for PD to be current?

3) Why does i130 approval take 1-2 years for some people? Did it take that long before?

Let's hope March Visa Bulletin brings some good news!

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

I believe the current date is Jan 2008.

Yep it may be approved in 5 months, however the petition will then go into cold storage at NVC until the priority date comes up.

Note Mexico is April 2005

We are answering the question, NO timeline is NOT possible, Petition will be approved and have a priority date at the time of approval, NVC is handling petitions that were approved 2 and 5 years ago and have priority dates at that time, (2008 and 2005 for Mexico)

Your time line is not realistic for a spouse of a green card holder

1. 01/2011 i-130 submitted

2. 06/2011 i-130 approved (est. 5 months)

3. 07/2011 NVC received case and wait for a visa number to be available for F2A

4. 07/2014 assign Case #

5. 09/2014 Case completed

6. 10/2014 Schedule interview

7. 11/2014 Visa received

8. 12/2014 Arrive in USA

The above if more realistic Note the wait between steps 3 and 4

This will not be over quickly. You will not enjoy this.

Petition will be approved and have a priority date at the time of approval

Isn't it true that i130 will be approved independent of PD being current?

If PD isn't current at the time of approval, the case will just sit at NVC?

NVC is handling petitions that were approved 2 and 5 years ago and have priority dates at that time, (2008 and 2005 for Mexico)

You can assume that but it isn't a realistic assumption. The time line you provided would be reasonable for a USC that doesn't have to wait for an available visa number. Your actually time line will be extended by whatever the wait for a visa number time is from the day you are approved to the day a number is availble. The rest of the process is the same as for a USC.

This will not be over quickly. You will not enjoy this.

The receipt notice say my PD is in Jan 2011.

If the i130 is approved on July 1, 2011, does my PD change to 07JUL11???

I thought PD is the time USCIS received your case and it doesn't change...?

You can assume that but it isn't a realistic assumption. The time line you provided would be reasonable for a USC that doesn't have to wait for an available visa number. Your actually time line will be extended by whatever the wait for a visa number time is from the day you are approved to the day a number is availble. yes i know it's unrealistic.

but who would have known PD jumped so fast in 2010.

let's hope that it moves FORWARD again in the coming months back to 01AUG2010 and beyond :)

let's hope that it moves FORWARD again in the coming months back to 01AUG2010 and beyond :)

I guess your timeline looks fairly reasonable if we assume that the F2A is current. No matter what the cutoff date is, you can go up to the step 4 without any problem. We have to hope for the best. It's not impossible that we hear good news in the upcoming months.
