If I assume PD is current when my i-130 is approved in 07/2011 and remain current until

interview is scheduled (see assumption in original post)

can my original timeline be remotely possible?

The PD must be current AT THE TIME OF VISA APPROVAL/ISSUANCE

Hi all,

I recently submitted the i130 in Jan,2011 and got the receipt in a week.

Would like to know what's the best case scenario for my spouse to come here.

This is what I'm hoping:

1. 01/2011 i-130 submitted

2. 06/2011 i-130 approved (est. 5 months)

3. 07/2011 NVC received case and assign Case #

4. 09/2011 Case completed

5. 10/2011 Schedule interview

6. 11/2011 Visa received

7. 12/2011 Arrive in USA

Assumption : PD is current during step 2 to step 5. (I know it's unlikely...but we can hope)

Some more questions :

1) If PD is still not current when my i130 is approved, will my case still get transferred to NVC

and wait for PD to be current? i.e. idling at step 3?

2) Must the PD be current through step 3 to step 5?

i.e. If PD is somehow retrogress again after NVC complete the case,

I'd still have to wait for PD to be current?

3) Why does i130 approval take 1-2 years for some people? Did it take that long before?

Let's hope March Visa Bulletin brings some good news!

Answers..:

1. If the PD isnt current at time of approval from USCIS the case would still be transferred.

2a. You will be assigned a case number yes- even if your case isn't current.

2b. Well your case will not be process so they will not ask for documents until your case becomes current because if they

become outdated you'd be required to submit the updated forms.

2c. An interview will not be scheduled unless there is a visa available for you

3. Why did the I-130 take 1- years for some people...? Well USCIS's processing structure was poor and the average

processing times were more than 2 years for the F2A category. For eg. I-130(F3) adjudicating back in 2004-9 took 3-6

years. As of about June/July 2010 they have set a processing time of 5 months for the I-130s. Some countries undergo

additional security checks (name etc) and their approvals are "stretched"

Hope someone will have some other answers.
