Why is a second petition so important at this point? Not allowing her to enter the US would be my primary concern.

Agreed, this is "strange". Seems you are more concerned about filing for someone else VisaJourneyDude, than you are about her entering 'illegally' on a K-1.

The visa is only for 6 months then it will expire, has it expired yet? If not, then just call to cancel it first so you will be worry-free :)

My Journey:

We met through a study-abroad program in Shanghai, China in August of 2009

We got engaged March of 2010

I received my K1 VISA in 6 months (June-December 2010)

We were married 04/02/2011
I received my conditional 2-year greencard (AOS) in 2.5 months with no interview (April-June 2011)

Our son was born 02/03/2013

I received my masters degree in Speech-Language Pathology 04/17/2013

I received my 10-year greencard (ROC) in 3 months with no interview (March-June 2013)

My husband returned from deployment 06/20/2013

My naturalization journey took 4 months (April-August 2014)

I became a US citizen on 08/01/2014

Received passport in 3 weeks (regular processing)

Well if I decide to do this again WITH ANOTHER WOMAN, I'm just worried that it might be too painful of a process.

I would notify the DOS and see what they tell you. It does not look good on your record. I know first hand. Get it removed from your record and have the case closed.

So, I don't need to wait for 2 years or ask for a waiver since she never flew to the states and used her Visa... is this correct?

IMBRA places two restrictions on multiple K1 visas in cases where the petitioner has:

1) Filed two or more K-1 visa petitions at any time in the past, or

2) Previously had a K-1 visa petition approved within two years prior to the filing of the current petition.

A waiver may be obtained, however. Factors the USCIS will consider in evaluating the waiver application include, but are not limited to:

a)Whether unusual circumstances exist (e.g. death or incapacity of prior beneficiary(ies));

b)Whether the petitioner appears to have a history of domestic violence;

c)Whether it appears the petitioner has a pattern of filing multiple petitions for different beneficiaries at the same time, of filing and withdrawing petitions, or obtaining approvals of petitions every few years.

If the petitioner has a history of violent offenses, the USCIS will require extraordinary circumstances in order to grant a visa waiver.

Just wondering.. Have you met someone else and are you planning to petition her soon or are you just talking hypothetical here, like for future reference? Might help clear things up!

I am so sorry to hear that! I really dont know what happend why did she turned her back on you or braking u up after she got her visa!!!, she is insane! sorry to say this but i have to say these for me and my fiance and all the couple's who are patiently waiting for the approval of their visa just to be with and to start a brand new life together!!! She doesnt even know the feelings of how hard sleeping at night and waking up alone evryday!!! I know your goin to do something with this #######! good luck to you! (agnes)

I haven't met anyone abroad yet. My brother asked me if I notified Visa Service to cancel her Visa. I thought I'd just let it expire but now I've been thinking if I ever want to do this again that it might bite me in the foot if I just let it expire. I'm already going to call this Monday.

well i think there is nothing wrong if the OP asked how he can cancel the issued visa to her x-fiancee, yeah he maybe later file again for another woman and if he didnt act now it might cause problem with his application and also for his x-fiancee too, what if she met another USC man and the USC man like to petition her so at least she is safe to have a k1 again...

it doesn´t surprise me at all! LDR are hard to endure, especially if one of the persons involved is not consistent enough. I guess that all the time the Govermente makes us wait is a way to prove our relationship in the hope that some drop out.

Me myself I´m already tired. I mean, my fiancé could´ve married me in June when we knew I had to go back to Spain ´coz I lost my job, instead, he let me go, and then filed for the K1. So, i´ve wasted 2 years of my life, which will be 2 years and 6 months by the time the visa is granted.

Waste of money and time.

I´m glad for those of you who have a couple who is really in love with you and who wants to make the long distance relationship less hard by sending sweet e-mails, skype, and visits. I wish my fiancé were in love and do those things. I´ve mentioned them to him but seems like he´s perfectly fine with only a daily 10-minute call.

I´m sounding bitter. I´m sorry.

I had a similar situation a few years ago except that we broke up after NOA2 and before the interview. We kept in contact for awhile and had a civil relationship so I'm sure she didn't try to go to the interview. She didn't have my financial records anyway for evidence of support so she couldn't have got a visa approved without that. Shortly after NOA2 I sent a letter to the service center telling them to cancel it since we had broken up. I'm not sure if that was the best way to handle it. Others are probably right that it is better to contact the State Dept at this point in the process. I didn't research it back then - just sent the letter to the address that I knew of. But it seemed to work. I just got approval on my second K1 and we are trying to schedule the interview soon. We filed after two years had passed so the two year period wasn't an issue. The NOA2 letter did mention that I had been entered into a database to track multiple petitions since this was my second one. I sure hope this second one is the last one I'll ever need!
