Breakup after K1 approved

Timeline

Approved as in I-129F approved by USCIS, or as in interviewed by consulate?

If not interviewed yet but petition was approved, I would call DOS Visa services and get it withdrawn.

If was approved and has visa, again I would contact DOS visa services and ask about it, they may revoke it. The Visa is essentially useless for the visa holder, it cannot be used to enter the USA and marry someone else.

Yes she went to the consulate for an interview and they granted her a Visa. So I don't contact the consulate... I contact the DOS? Can I get a contact info?

If I decide to apply for K1 visa again, how long do I have to wait to do this?

In essence could file an I-129F tomorrow for another K-1, the first petition did not result in a marriage and green-card... Especially if you get the first one revoked.

Thank you very much for that info YuAndDan. But I read something in this site that you must wait 2 years to apply again. What is that all about?

This has to do with IMBRA law, has to do with excessive petitions.

I am not fully versed, but I believe has to do with going all the way with the K-1, as in approved, and then used, only to have failure after used. Then again if USCIS has issue with a second petition within to years, they can require a waiver.

When you say "used" does this mean they use the visa to fly to the states or do you mean fly to the states and also get married?

Fly to states and marries you, cannot marry someone else and expect to be able to get a green-card.

I agree - call DOS and let them know right away. And ask them if they suggest you contact CBP (Customs and Border Patrol) as well.
