Hi All,

Our lawyer in the States in his checklist of documents to supply with the I-129 form has asked me to submit my Indian passport copies to him. I have not seen this anywhere else being mentioned, but since my passport has been sent to the passport office here, for some corrections, I can't send my passport copies right now. However, I do have my Indian birth certificate and its translations ready and can send them to him. Since we don't want to wait for the passport to come back before we apply for the I-129, I was wondering, if anyone has any experience in this? Do we need my passport to apply or can we go ahead with just my birth certificate for now? Has anybody receied an RFE for this?

We did not send a copy of my fiancees passport, she is the beneficiary, I did however send copies of my own, you will of course need it at the interview but I see no reason you should be required to send it for the I-129F.

Call me wrong anyone?

Hi All,

This is not required. Your biographic datas only in g-325 needed. Benefecary will need these papers at intervew, not when send in I-129F. Maybe its because India is big country, maybe its easier for them if they are making namecheck about you in your corner. Maybe she just mixed something.

Thanks everyone for the reply. We haven't sent in our form yet, so we can send in ours now. I was also under the impression we do not need to send in the beneficiary's passport copies, even though I ahve been to the States in transit a long time abck, 6 years ago. I think our lawyer is just trying to be extra careful with extra docs.

Maybe some of you were not clear by the way, I am the beneficiary :)

Why not ask your lawyer why he thinks the benficiary's passport is required at this stage since it isn't? This will be a good indicator of whether or not he knows what he is doing and if you actually want to proceed with him.

The only reason I can think that you might need the beneficiary's passport is if you are using passport stamps from that passport as proof of having met in person in the last two years.

If you have other evidence that you can use for that purpose, there is no need to have the beneficiary's passport at this point.

Some reasons that lawyers may use things such as passports of the beneficiay or even a drivers licence of a beneficiary is to assist with the background/security checks as it is more identification that may clear up any false hits in a speedier manner. It actually isnt such a bad idea and does no harm.

And I agree there's no harm in sending it and I would ahve, but I wont get the corrected the passport for another 2-3 weeks and was wondering whether it would be ok to send our petition as is...since we don't want to waste time waiting for it if its not required as of now....

If you won't need your passport to show proof of meeting, you're okay because sending it out is not a required at this point. To follow what aussiewench said about name hits, I guess you could then send them your birth certificate instead (although it's not required either).

I suspect that you're on target.

One of the things that one pays an attorney for is to avoid as many problems as is possible, including the oddball problems that rarely happen (but piss people off royally when they do happen). If an attorney has had a problem once, they'll do their best to see that it never again happens to another client.
