Hi,

On 10/2010 I filed N-400 based on marriage. In N-400 application I answered NO on the question in part 10 "Have you ever failed to file Federal tax?". Also I filed tax return for 2009 together with other supporting documents. After biometrics letter, I received a Yellow letter, stating that I need to bring my ID and tax transcripts for the past three years. So I started calling to IRS to order tax transcripts, through automated service. I was able to order 2009, 2008 but was unable to get 2007. When I spoke to IRS rep, she told me that they had never received my 2007 taxes. Obviously smth was wrong with the post delivery or smth. So we refiled 2007 taxes in December, 2010. Now I realize that now it would look like I lied in my application.

Did anybody have such kind of experience? Please give any advice

if they ask you, you can explain at the interview, it wasn't fraud on your part, and in the end, you did file it before the interview, so you have filed taxes.

This goes along in why 85% of Americans do not trust their government, I am sure in that list. Gave six years of my life to this country, now a veteran of a foreign war. For some strange reason, even as an 18 year old kid, saved all my military records, the original copies, quite a thick file. When I applied for VA benefits in Illinois, was rejected by their VA due to some kind of fire in St. Louis. Said no problem, I have all of my original records, they wouldn't accept those, can't tell you how I felt as to whom the true enemy is. Certainly not another 18 year kid forced to fight for his country. My attitude entirely changed. Was rejected in Illinois, but when I moved to Wisconsin, the VA office here is far more understanding. So finally got recognized for my effort.

Same with the IRS, in 1995 they paid over 67 billion bucks for a computer system that didn't work, gave me a hard time for spending a mere $15,000 for computers and software, but I tossed that back in their laps. IRS is also a bunch of criminals in my opinion. Was with my experience with the VA to hang unto anything dealing with our crazy government. Have all my tax returns dating back for the last 25 years, our immigration file is already ten inches thick with every piece of paper. Was thinking of having a burning party, but you never know when dealing with a crooked careless government loaded with incompetent people that are far more interested in retirement at age 55 than doing a decent job.

Do I sound bitter? Not hardly, just a series of bad experience, and we have a government that runs on paper. If you don't have that paper, you are screwed. Knowing that my stepdaughter would be going though citizenship, started a file on her with all impertinent documents. But only because I have done that, she did get all of her transcripts from the IRS. If we didn't, would be screwed like you. Just wonder if they know we are keeping records?

I understand why you think the way you do but I would not be worried. You did file in time, so you did not lie, and just recently learned that they did not receive them, which is why you filed again, thus a second time.

It is very unlikely that the I.O. will even spend more than 10 seconds on looking over your tax transcripts. More like 5 to 6, and only in order to see if there are indeed 3. Seriously.

There is no room in this country for hyphenated Americanism. When I refer to hyphenated Americans, I do not refer to naturalized Americans. Some of the very best Americans I have ever known were naturalized Americans, Americans born abroad. But a hyphenated American is not an American at all . . . . Agree with Just Bob - when they looked at my tax transcripts they looked at the year for which they were filed. She checked through them so quickly it was obvious all she was looking at was to make sure there were tax transcripts for the year in question and checking them off on her list. I doubt the interviewer will be looking at when the tax return was filed - but if you are questioned tell her exactly what you told us - that you didn't realize until you ordered the transcripts that there wasn't a 2007 return listed - so you refiled.

Basika! Don't HOPE! BE PREPARED if they ask about it! For example: Did you have a refund for that year or did you have to pay? How come you didn't notice that the taxes filed were not received. You don't have to answer here just be prepared! Think of any questions s/he may ask you.

I am saying this because I am in a little trouble due to State taxes filed late one year (the officer was also very peculiar though). Even though I explained everything, after the interview I received a letter telling me to write "a sworn notarized statement" why I "owe taxes". (Which I actually don't... but I guess they wanted my explanation in writing about late filing).

Just saying...

Thank you everybody for advices! I really hope they would not pay attention to it.

Do you plan on filing 2010 taxes before the interview? It that's the case, you wouldn't even have to back that far. They ask for the last 3 years so it will be 08,09 and 2010 transcripts. As far as 07 is considered you should be fine with an explanation and the fact that you corrected it immediately, should work in your favor. Good luck.

That is what I am trying to do, be prepared for any questions. We actually owed about 300 and sent the check together with the taxes. And didn't check if it was cashed or not. I know... it was stupid.

Szilvia74, can you tell me did the officer notice that you filed late by the date on the transcript or how?

I thought about it. But IRS wouldn't process it that quick. It takes about 4-8 weeks to process. And I already filed for the naturalization and waiting for the interview letter. I can bring just the copy of what i filed, but not the transcript.
