Hi,

I just went through the K-1 process and was married last Saturday. I was wondering if I have to send Immigration something immediately to prove that we got married with in the 90 day period or if the submission of our marriage license would prove that. Also, I was wondering if you had to submit the I-485 within a specific time period after our marriage. I couldn't find a specific time period that I had to submit it and was wondering if it was sent in a month or so if that would be okay. Thanks a lot.

you are fine to send it within the month there is no time limit when you should send the I-485 and Congrats on the marriage

You will need to send a copy of marriage certificate when adjusting status.

Need to marry within 90 days of entry, many file AOS outside the 90 days due to waiting for something like marriage cert, filing a tax return to use a copy with the I-864..

OK so we got married on day 86 or so after her entry, so do I have to immediately inform immigration that we have married or will my preachers submission of the signed marriage license inform them? I just really don't want to mes this up and am a bit confused.

You will be informing USCIS of this change in status when you file to Adjust status, File I-485. You need to no nothing prior to this.

Okay so if I file for adjustment of status let's just say 135 days after her arrival, as long as we got married within the 90 days then everything is fine, correct? Thank you so much, just really scared of blowing it after all the the effort used to get to this point.

Yep this is fine, you simply file I-485 ASAP, it can be outside the 90 days, just don't go too long.

All time spent out of status adds up, if more than 180 days out of status, then don't attempt to travel out of the USA even with an AP doc, the 180+ overstay triggers a bar on re-entry even with an AP doc, need to wait for green-card to travel.

It is advisable to apply for AOS as soon as possible. You can find the following on the USCI web site.

If You are Present in the United States as a K-1 Fiance(e)

You should apply for adjustment as soon as you marry your fiancé(e). By law and regulations, you are required to marry the U.S. citizen who petitioned for you within 90 days of your admission to the United States in K-1 status. If you fail to marry, you will become removable from the United States and cannot adjust through any other means.

You'll inform USCIS that you got married when you file the AOS package. As others have said, there's no statutory time limit to file the AOS.

I'm confused about your "preacher's submission of the signed marriage license". Submission to whom? He isn't sending the marriage license to USCIS, is he? In most states, these have to be filed with the county clerk's office. You'll need to get a certified copy of the marriage certificate once the license has been filed. You'll need to send a copy of the certified marriage certificate with the AOS package. Filing a marriage license with the county clerk doesn't automatically notify USCIS of anything - two different agencies of two different governments; state and federal.

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

Sounds like submission to the local state or county office that handles these things, and then that office sends out a marriage certificate.

Note this does not inform USCIS of anything.
