So our K-1 packet is almost all set and ready to go. We received a "divorce judgement" from the lawyer today, which is a Court Order stating that "the court decides they should be divorced and it takes effect 31 days from the date of this order" (which was dated Dec 29th. It is signed by the judge/clerk of the court.

Is this enough to send in as proof of divorce??? OR do I have to wait for the actual Divorce Certificate, which won't be for another 3 weeks at least?

My belief is that you need to be free to marry at the of the filing date. Seems like you should wait until Feb 1.

As of Dec 7, 2009, now Zero miles apart (literally)!

It's likey you will get a RFE since a person is not legally divorced. Should be divorced and actually divorced is significant. The requirement specifically state a copy of the divorce decree is required. Personally I would not take the chance.

In order to file an I-129F you need proof that you are free to marry at the time of petition filing, you need to attach a photocopy of the divorce certificate. I would wait for the certificate.

I agree. One of the requirements is that you are free to marry. If you send it now then you are legally not free to marry. I would wait until February 1st. No need to bother with all the hassles of the RFE. Me, personally, I would worry also that you would get someone at USCIS that would outright deny you for still being legally married.

K1 Journey:

Filed: 2009-01-12... USCIS Approved: 2009-06-05... 1st Interview/Admin Review: 2009-09-09...2nd Interview/Approved: 2010-01-27

AOS Journey:

Filed: 2010-05-20... Interview: 2010-11-30... Approved: 2010-12-03... Card Rcvd: 2010-12-18...

Whew! Done!.... Well, for the next two years anyway...
