ok...here's the dilema...I am with my husband in Pakistan. We are leaving in less than 10 hours to fly to islamabad to the embassy there.I am a disabled American (NOT pak-American) I DO have a joint sponsor. We will be living with her (I was living there before I returned to pk) She is single and lives alone. So my questions are many(naturally lol)

#1- what income level must she meet?? $18212??

#2- does she claim him as a household member and file taxes on him?

#3- which form does the joint sponsor fill out exactly???

#4- any idea of how long this will take? I'm ready to go home! lol

#5- I receive disability checks from the govt- how will this affect my disability payments? Will I go to jail???ugh...so much anxiety... I'm gonna start a friggin clinic for survivors of the immigtation process LOL

returned to usa alone july 2007

returned to PK september 2009 until present

opted for the IR1 rather than the K3 cuz it seemed like a better idea- no work permit and 2 more years of waiting for his LPR.

I do not think the embassy in PK does DCF but I'm gonna give it a try- and if they don't then at least I will get some infor from them (I hope!)

Please send any information and help as quickly as possible and thanks in advance for any assistance recieved.

#1- what income level must she meet?? $18212?? Correct, unless the 2011 poverty levels change.

#2- does she claim him as a household member and file taxes on him? No - read on who dependants can be - your husband does not qualify.

#3- which form does the joint sponsor fill out exactly??? I-864 or I-864A if it is from a family member or member of household (as it seems you will be in the same household)

#4- any idea of how long this will take? I'm ready to go home! lol 3-6 months is usual, but since you're in Pakistan, there could be additional administrative processes done on your husband's background - from 2 months to even more than 6 months depending on the case

I'm gonna start a friggin clinic for survivors of the immigtation process LOL No, why would you go to jail? As your husband's principal sponsor, YOU will also fill out a I-864 form. If you haven't done your taxes in the past, you will want to catch up on the last 3 years of it. If insufficient level of income reported and no need to file taxes, you need to provide a statement from you with supporting evidence why you didn't have to file taxes.

thanks for the quick response-I'm still confused about the joint sponsor situation. See, the I864A she has filled out- but it appears that she must add him to her household and claim him on her taxes. I'm VERY VERY confused and extremely concerned in this point... the other points are cearing up in my mind- it's the joint sponsor thing that has me very confused.

Ad what suporting evidence do I need to prove that due to my disability I am exempt from filing taxes? And have been for 13 years...

more info- my joint sponsor is NOT a family member or relative- she is my best friend only. no relation

IRS and USCIS forms are two separate things. Husband can't be claimed as dependant for IRS tax filing purposes - she is just sponsoring him, NOT providing for him. I-864 is in case the immigrant draws specific benefits so the government can go after sponsor and co-sponsor to get the money back - rarely enforced simply because the immigrant does not qualify for those benefits for the first 5 years, and by year 5 he can already be a USC.

Disability issue - get a SSA statement of benefits - should have explanation on your disability income and whether it is taxable or not.

Yes, you are confused. Why not put the affidavit of support issues aside for now. You haven't even filed the petition yet. You don't mention whether this person is a family member. If not, then she would provide an I-864 and is not your household member whether you live at the same address or not. Providing and affidavit of support does not make the visa applicant the sponsor's dependent for tax purposes. It has no impact on their tax filing whatsoever.

No, why would you go to jail? As your husband's principal sponsor, YOU will also fill out a I-864 form. If you haven't done your taxes in the past, you will want to catch up on the last 3 years of it. Because she's been living outside of the US and receiving Disability payments from the US Government. There are restrictions such as living in the US (and it's territories) to receive some of these benefits.

I agree, read social security website and you will see restrictions. my husband receives it no problem for Honduras.

i know there is restrictions on ssi ..but ssdi you have to remain us citizen..but can get check

let me further explain my recent post:) ssi there is limitations but ssdi as long as u remain a us citizen you can get check as long as the country is a friendly country of usa not hostile..lol
