i have a question about providing evidence of previous divorces. My husband has been able to find his previous divorce certificate but had a prior marriage and divorce which lasted for 20 years while he was living in Alaska. He has not got a copy of these papers now and when we apporached Alaskan courts for a copy of his marriage and divorce, they wrote back and said there was no record of either taking place. He was obviously able to marry after this to his second wife ( i am his 3rd wife). All Alaska were able to do was to send a letter with the state seal, saying that they could find no record of his marriage or divorce. Will this be adequate to prove that he was free to re-marry?

Hope somebody can shed some light on this for us. We are waiting anxiously for NOA2 having been transferred from CSC to TSC and 5 month time has now passed.

Are you sure you checked the county court where the divorce took place? Would likely be in the county the person (husband, or wife) who filed for divorce lived.

Thanks for the reply yes we did. the marriage and divorce took place in palmer AK and we spoke to the court house records dept and filed a proper divorce certificate request as per Alaskan procedures. My husband is positive it happened in Palmer. I wonder if his memory is failing him?! Anyway is this state sealed letter going to be enough in your opinion?

They do background checks and FBI checks. I wouldn't rely on a letter like that if you know there was a marriage and a divorce.

They do background checks and FBI checks. I wouldn't rely on a letter like that if you know there was a marriage and a divorce.

Not sure those checks will be relevant to the issue at hand, but in my experience USCIS wants to see a divorce decree or death certificate for any legal marriage you disclose. They might accept an affidavit of explanation plus the letter with seal as evidence the document is not available. See the I-130 instructions regarding documents that are not available.

This is the problem with marriage records in the United States. It is very easy to get married even if you are still married by just going to a different state. When I started working on a church annulment from my previous wife I needed records of her previous marriages and like you came up with nothing. I finally tried Ancestry.com and was able to track her marriage to Nevada. You could try one of those websites or pay a P.I. to see if they can find anything.

It is actually very easy to marry someone while you are still married to someone else in the US. It happens everyday. Be sure that you get the documents.

thanks - i just talked with him and he said it was him who filed for thr divorce - not his ex - and he is certain it was in Palmer Alaska although he lived in nearby Wasilla. maybe we should try contacting them again

You can contact the State of Alaska Vital records Dept, they should have an event record. They should have a record of the event (divorce) ! They can give you a letter certified letter stating that the event(divorce ) took place and when. They will not be able to supply information as to the specifics of the decree! I had the same problem in Ga. My ex ,me, or the county courthouse had a copy of the divorce papers. I sent a request for a record search using both of our names and the approximate year the divorce took place. It took the Vital Records Dept about 3 weeks to get my certified letter to me. I used the letter for my current wife's immigration process with no problems! Good Luck, Robby

we sent a request to the state vital records too a while back but still nothing. its strange. My husband reckons it might have all been a dream! seriously i hope this won't become too much of an issue but we will continue to investigate as it seems we really do need something more concrete than the fact that no marriage or divorce ever took place on record. If i look at us people search it shows him and his ex living at all the same addresses - just no record of their marriage
