Hi,

My husband came from overseas through a marriage visa. Since we haven't reached our 2 year anniversary yet he is a conditional resident. Recently we found out that his mother is in ICU and there is a 90% chance she wont make it. He wants to go back to overseas for 10 days, him and his older brother want to travel. My aunt works at the hospital his mother's in. I made an infopass appointment for him to visit the local immigration office, its Tuesday. I want to know if anyone has had this experience before? He's only been here 6 months, he has a job and everything here now. Do you think immigration will have a problem with him going since he hasn't been here too long? I mean his mom is dying.

I wouldnt have thought so, as long as the correct procedures are followed, he maintains evidence (should it be requested, more for your own benefit than anything) and doesnt stay out of the US for too long.

If he has his green card he should be able to travel without issue.

No need even to attend the infopass appointment if he has a green card. He's free to travel. For more information on maintaining his status, simply Google, "maintaining permanent resident status US".

I think you mean his greencard expires then; his visa as to enter the USA, and then he became a LPR )legal permanent resident).

Right. The visa is dead and gone. His status is indicated by the green card and it is the card and status expiration date that counts now.

So no problem. He can travel freely until July 2012. Keep in mind if he stays out of the US for more than 6 months, some other things come into play. If he is staying less than 6 months there is no issue at all.
