I filed form I-129F for my fiancee and my NOA1 was on July 29th of 2010. My tax return for the year 2009 wasn't enough to be a sponsor. However, in 2010 which ends in few days I made almost $35000.

The year is almost over, I didn't receive the NOA2 yet, so obviously we will get it in early 2011, and the interview will be in 2011, too.

My questions are

Will my application be denied because in 2009 didn't make enough money?

If not, and my fiancee goes to interview, which tax return would be go by? The new one for 2010, or the old one of 2009 since this was the one available when I filed

I'm also kind of wondering this... I didn't file my taxes in 2009 considering I wasn't working. I make enough now, but only started this job halfway through the year. I'm assuming file for 2010 and then use those. That's what I'm going to do. (Going to file for 2010 as soon as possible since it shows me making a wage that is sufficient.)

For k1 (form I-134), If you get interview in 2011, you can turn in your 2010 tax return. They ask for recent tax return, of course it's 2010 if you file in time.

H and H is correct. According to the instructions for the I-864, which is the official affidavit you will use for AOS, what is required is the most recent return. You can submit up to three if that will help your case but its not required.

9/9/10: I-129F Sent

9/16/10: Received NOA1 in mail (dated 9/13/10)

10/03/10: Touched to the dusty shelves!

2/28/11: NOA2 finally

This is the second time in the past week I saw this issue come up- sufficient current income but recent tax return not having sufficient income. In the K-1 guides and the FAQ for the Affidavit of Support there is little or no mention of tax returns. Perhaps this should be added in the guides. Unless you are someone that frequents the forums and reads the posts, this could easily be overlooked.

Are you talking about the I-134 affidavit of support and the information for it from the Guides?

If you aren't seeing specific mention about tax return requirements, that is because the instructions for the form don't specify that a tax return MUST be submitted to the consulate with the affidavit.

Whether or not one tax return is required, or none, or three, is a consulate specific issue.
