Hi everyone,

I want to ask you a question.

My friend is applying for his green card (through marriage) and at the moment filling out the forms needed.

For form I-485 where it says "List your present husband/wife and children"

does he have to list the names of his wife's children?

I have heard you should do that, and list them, and write for them step-son or step-daughter,

and where it asks you "Are they applying with you" to choose "No".

Is this true?

What is the best thing to do here?

My friend who is filing the petition I-485 actually does NOT have any kids? His wife (she is the American citizen) has 3 kids of which only her youngest one lives with them.

Should he list only the youngest one, and write his name and put "step-son", or should he write all 3 kids, or should he NOT list any of them at all?

What do you think?

write his wife name and as he does not have kids then none. I wrote my 2 daughters but not my husbands daughters I am the beneficiary. They are not my children even though they are step daughters but they don't live with us and are grown. I have not had a problem. If he wants to put the one child who lives with them if he is young but stipulate he is step son.

Sorry to bump this old thread but i'm in the same boat. My wife (us citizen) has 3 kids(all citizens) that live with us should I put their names or not? We don't have any children together and I don't have any children from another relationship.

No you do not list them, they're "not" your kids. The I-485 is your application pertaining to your biological children. This information is mainly required for biographic and for follow up derivative statuses for your children. Your spouses U.S. Citizen kids though technically yours too don't add up.

Adjustment of Status From F-1 Visa.

8/14/2014: Mailed AOS package: I-130, I-485, I-765.

8/18/2014: Accepted in Chicago. Transferred to Nebraska Service Center.

8/21/2014: Received NOA 1. I-130, I-485, I-765 in mail.

8/25/2014: Received biometrics in mail. Scheduled for 9/8/2014

9/24/2014: EAD approved. 36 Days!

10/01/2014: EAD mailed.

10/03/2014: Received EAD card.

10/14/2014: I-485 moved to testing and interview.

1/28/2015: Interview scheduled for 3/4/2015.

1/31/2015: Received interview notice.

3/4/2015: Interview completed and APPROVED!

Your friend should write "none" as those are not his biological kids USCIS is asking for.

I've read conflicting information on this. Some lawyers say it's better to put the names of all kids living in the same roof.

Your friend should write "none" as those are not his biological kids USCIS is asking for.

Hi.

This question was so long ago, I even forgot I had asked it... :)

It was answered multiple times already, and YES - the correct answer for this question "For form I-485 where it says "List your present husband/wife and children"

does he have to list the names of his wife's children?" is: DO NOT LIST YOUR WIFE'S CHILDREN, WRITE NONE.

The application is for the person who is applying for a green card.

You should only list the applicant's children if any. If not any - write None on the first line.

That is what I did when my wife was applying for a green card through marriage to me.

She wrote none for children (neither of us had any children yet).

There is another form I-130 where it asks you information about your relative and there you list your spouse's info and their children if any.

But on the question here for form I-485 - the answer is to write None - for yourself - which means you have no biological children.
