Some of these things seem to have you a little confused. A 1040 is the primary form in a complete federal income tax return. A W2 is a form provided by an employer that summarizes gross pay and withholding of various taxes. An employee who receives W2's from their employer would include a W2 with their complete income tax return.

In other words, you don't send a 1040 by itself, nor a W2 by itself. A complete income tax return would probably include both of these. A complete income tax return is a bundle of forms you send to the IRS, including at least one variation of the 1040 form (1040, 1040A, 1040EZ) and any W2's the taxpayer received. It might also include 1099's and various other forms and schedules. A copy of a complete income tax return would be a copy of every one of those forms - whatever was sent to the IRS. A simpler method is to get transcripts of the return from the IRS. A transcript will contain the information from all of the forms that were included in the tax return package.

Most consulates only require either a copy of the most recent year's federal tax return or an IRS transcript of that return. Some consulates prefer the most recent three years. If you don't know your consulate's requirements, or you just want to play it safe, then submit three years of transcripts. You can order the transcripts by calling the IRS, and they're free.

If the letter of employment is recent then you may not need pay stubs. If you decide to include them then the prior six months should be enough.

Phone records and boarding passes are not included with the I-134. They are relationship evidence. Bank statements are useful if the sponsor is self-employed and doesn't receive checks to prove recent income, or if they are using assets in a bank account to help them qualify.

Two recent pay stubs are enough. A W2 is part of a tax return. Include three complete tax returns if possible.

Most consulates don't really care how you answer that question because it's not really relevant to a K1 visa. In fact, it's not really relevant to any sort of visa. If you're signing an affidavit promising the government that you'll support an alien and ensure that they don't become a public charge then it's kind of redundant to give an itemized list of how you'll support them, or even give you the option of selecting a box that indicates you don't intend to do what the affidavit essentially requires you to do. The I-134 was designed by a bureaucrat who knew nothing about contract law. It's not legally enforceable, and USCIS doesn't use it anymore. Consulates use it because it's a convenient way to summarize the financial status of a sponsor.

In any case...

The VJ example forms suggest you don't check either box, and just write "N/A (K1 visa process for permanent residence)" in the box below. For most consulates this will be fine. The only consulate I know that won't accept an I-134 filled out this way is London, which expects the "intend" box to be checked. I don't recall anyone saying the Embassy in Manila cares one way or the other.

When stating "most recent tax returns" does that mean the most recently filed tax returns? In my case I did not need to file the past two years because I dedicated myself to full time studies and made $0. According to the more important and more legally binding I-864 I would NOT need to present tax returns (or tax transcripts) for this reason and would simply need to write a letter explaining why I did not need to file (see instructions for I-864). I was told that the I-134 follows the I-864 since the I-864 is the official document. The I-134 would follow the I-864 in this aspect as well right? I

All I have is transcripts from 2006 and 2007. Is this considered "Most recent?"

Also I do have a full-time job, making well above the federal poverty guidelines with an employment letter, bank statements, and letter from bank officer to prove it. Also I have transcripts and letters to show that I just recently graduated with high honors from a University and a graduate level Bible school which would explain why I did not work for a little over two years and thus why I did not need to file taxes during that time.

Presenting tax returns is a guideline, not a requirement. If you have more current evidence of current income, like pay stubs and an employer letter, that will suffice as long as you provide a statement as to why you were not required to file a return for 2009.

By "most recent" "I" mean the most recent tax year, which at this moment is 2009.

What the consulate expects to receive with an I-134 is usually summarized in packet 4. Most will expect a copy of the most recent year's tax form or an IRS transcript of that return. Some will specifically ask for the transcript, but may accept a copy of the tax return in some cases.

2009 is currently the most recent tax year. After April 15th, 2011, then 2010 will be the most recent tax year. Obviously, you don't have a copy of a tax return for 2009, nor could you get an IRS transcript of a tax return for that year because you weren't required to file.

It's now December 12th and you don't have your NOA2 yet. It's a fair bet the interview won't be before the end of January, when you'll get your W2's for 2010. I suggest you file your 2010 return as soon as you get your W2's. A couple of weeks later you should be able to get transcripts of that return from the IRS.

You could also do as the I-864 instructions suggest, and just provide a letter explaining why you weren't required to file, but actually having a transcript will be simpler than having to explain anything. Include the other evidence you mentioned to prove you're currently employed and show your current income.

I have a question regarding tax return. I got my fiance's tax transcripts. He made less than 125% poverty line in 2008 and 2009 but he is making well over the poverty line now. Are 2008 and 2009 tax returns going to be a problem? I've got a letter from his employer and his paystubs to prove that he has been making more than enough since July 2009.
