My brother is in H1 visa. Can he sponsor my wife as I have filed i-130 for her. Thanks in advance

Nope.

The sponsor must be USC/LPR.

Other 2 points to be eligible are:

1) At least 18 years old

2) U.S Domiciled

O God, I am then screwed. I thought I can use my brother income as household income. I did not earn anything last year. I am working this year. What should I do? Please advice Thanks

If you're working now, perhaps you qualify on your own. Marriage carries responsibilities. The responsibilities are yours, not he US taxpayers.

I was dependent on his tax return last year. Should I wait for this coming tax year to send my I-864? I do not know any one with USC and GC that will agree to sponsor. Thanks

I know she is my responsibilty. That is the reason I married her. Does the NVC require 3 tax year returns? Thanks

Current year income and just last year return is what they need basically.

Get a letter of employment from you employer and your last 6 months or so of earnings statement or pay stubs. Search the forums here on VJ for a sample employment letter. Should simply state how long you worked for the company, your annual earnings, and state that you are a permanent employee with every prospect and intent of staying employed at the company. Remember, you have to meet the the "125% of poverty level" threshold now and into the foreseeable future, not last year or three years ago. If your current income doesn't meet this level, then you'll of course need a qualified co-sponsor who is a USC/LPR.
