Hello,

It has been more than two months since my wife and children have sent their passports to Montreal for visa issuance. The interview was done on June 15 but the visa was refused because we were a couple of documents short. After sending all the documents, the Montreal office asked us to send the passports which we did promptly but after that there is no response from them and upon calling Washington, I get a cold reply that Montreal office has a huge backlog.

I was wondering, since I'm in Houston, can I make a request to transfer my family's case to Houston instead. My family can travel from Canada to Houston on New Zealand passport on three month visitor's permit while their processing can continue in Houston.

Can anybody please advice if this is possible because we're fed up of waiting.

So what you are wanting is to have the case transferred to the US so they can issue immigrant visas to your family already inside the US and then have your family leave the US and return on the immigrant visa? I don't think it is possible to obtain an immigrant visa from inside the US.

The Montreal consulate will have the final say as to whether the visa application will be able to be forwarded to Houston. All you can do is contact them and see if they will do it or not.

Not sure about this, I haven't heard of transferring a case and entering on a different passport than the one being held for the immigrant visa. Have you tried contacting the Montreal consulate about this?

You need to complete the immigrant visa process at the foreign consulate. It will take little longer time since Montreal is backlogged. But, if everything is ok, you will eventually clear it up :thumbs:

Wow, I would strongly suspect that something is definitely wrong if it has been more than 2 months since you sent in your passports. Their automated phone system says 2-3 weeks. When we were at our interview the officer there told us 1 month.

You could try emailing or faxing the consulate. If you do, direct your correspondence to "IV Unit Supervisor" and make sure your primary applicant's case number and name appear in the subject line.

I did this and I ended up getting a call from the supervisor himself. He was annoyed but at the same time understanding. I'm not sure if it helped... we are still waiting for our visas to be issued as well.

Visas or for entering countries. They are not issued from within the country they are to be used to enter. The visas will be issued by a Consulate outside the USA, always.

Facts are cheap...knowing how to use them is precious...
