Timeline

We received an RFE for form I-693 today, but based on other topics on this forum the examination she had in Japan should have been sufficient. Is this no longer the case? She surrendered her examination at the POE so we have no back-up whatsoever as it was sealed. Specifically the RFE says "All USCIS records relating to you have been reviewed. The U.S. Department of State medical forms DS-2054, DS-2053, DS-3024, DS-3026 AND DS-3030 are not in any of those records."

I called USCIS and all the guy said was "You have to follow the instructions on the RFE and get a medical examination."

On top of all that the original RFE was lost in the mail and we didn't get a new one until today which has a nice "You are given until November 8, 2010 to submit the requested information." Hopefully the process we did to get another copy sent to us was enough to kick the deadline out another month. We originally got the email saying an RFE was coming September 27th and didn't get it until today.

So are we doomed to another examination or is there any way to avoid it? This process has been way too smooth for us so I guess we were bound to be tripped up somewhere along the way. Thanks

Some people have said they scheduled an infopass appointment and did some kicking and screaming, and also got their Congressman or Senator involved, and USCIS managed to mysteriously "find" the missing documents. You could try that route, or just give in and get the full medical done.

USCIS has been known to not be very forgiving of lost mail, and often presume that it was the applicant's procrastination rather than an actual error by the post office that caused the delay. They can deny the AOS petition for "lack of timely response". If I were you, I'd get the medical tomorrow and get the I-693 packet from the civil surgeon in the mail as soon as possible.

Thanks for the replies, I was afraid of that. I actually called the Civil Surgeon the USCIS suggested but they were already closed for the day. I want to do it as soon as possible but we are going to visit my parents for Thanksgiving, leaving tomorrow afternoon. Could we do her examination at a place near my parents? I'm assuming it is OK, but it never hurts to ask.

I got the EXACT SAME RFE word for word. What it means is they LOST your original medical from the K1 Visa. I tried EVERYTHING to find it. I called the foreign Civil Surgeon, I called the border where we POE'd, we made an INFO PASS, bottom line: we ended up having to re-do the entire medical (just the I-693, the other forms are for K-1 Visa only and are repeats of the I-693).

Do yourself a favor and just re-do the medical and save yourself the frustration.

You can get the exam by any civil surgeon, BUT it will include a TB skin test that has to be read a few days later. Are you spending enough time in the other city to complete the exam? Take immunization records with you or the DS-3025 record if there are recent shots she doesn't want to repeat.

I do the medical an take almost a week get the results! First because i need to back in 2 days for see if i have a reaction with my skin test and then1 day more for the blood test!! :wacko:

Maybe you can ask him for do this a little bit more fast , you can show him the RFE . . also when i was there i show all my records for vaccination and they dont care i got 2 shoots anyways , they said i dont have the records that they are looking for , i got one more blood test , almost i have all the medical again , ust i dont get the X ray . . my husband pay 323 USD for all of this . . :crying:

Then yo can send everything by over night mail so they can get it the next day and is not expensive we pay 20 USD for the full package of AOS for you can be cheaper :thumbs:

I called the Civil Surgeon this morning (in my local area) and have scheduled an appointment next Wednesday. I don't think there will be enough time at my parent's to get everything done soon enough. They said if we don't have proof of the TB skin test, which I don't think we have, then they will do that on Wednesday then the full examination on Friday. All in all, I think this is the best we could have hoped for, I checked out doing an Infopass appointment, but the earliest available slot is December 6th, by which time the examination will be done.

Thanks everybody for your replies and help. It's been pretty frustrating when you think you have done everything (in this case we actually did do everything) and then a curveball gets thrown. Only thing I am worried about now is the November 8th due date, but there isn't much I can do about that but hope the system realizes why we missed it.

Don't assume that just because you never received the first RFE, you're going to be allowed to just send it in after their deadline.

I know this isn't very helpful, because I can't say what you should do to fix it, but hopefully someone else will be able to chime in with how-to advice or you can call them and ask.

This is true, but at this point there's not much else he can do. He needs the I-693 to go forward. If they deny the AOS because the response was not timely filed, at least he'll have a good basis for a motion to reopen.

In the meantime, before the Wednesday appt would it be easy for you to go for an infopass. Somethimes, it is not helpful but sometimes they have information that could help you. When you send the medical if that what you have to do. You could send a photocoy of the poststamp of when the RFE that you recieved was mailed the second time. I hope it all works out for you!
