I just filed for the second time within 2 years too. There is no form for this. I just included in my I-129F petition a letter saying that I'm requesting a waiver because I am filing a second I-129F within two years. I included a copy of the letter I sent to the U.S. Embassy in Manila requesting that my petition be canceled, a copy of the letter the U.S. Embassy in Manila sent to me stating that my petition had been canceled and I also included a copy of the email the U.S. Embassy in Manila sent me saying that they had sent my petition back to NVC for proper disposition. I called USCIS when I read that I needed a waiver and this is what they said I should do. All the best...

Yes, a letter is all that is needed and it can even be just a paragraph added to your cover letter but I would give a reason for the waiver request including WHY the first process wasn't completed or why the relationship didn't work out etc. Just a sentence or two of "why" should be sufficient.

Facts are cheap...knowing how to use them is precious...

What you need is a letter submitted apparently with you application. Here is a sample from a member named godsgift.

The letter need not be complicated. Can be as simple as the sample below.

United States Department of Homeland Security

U.S. Citizenship and Immigration Services

[ ] Service Center

PO Box xxxxxx

Any Town, Any State

To Whom It May Concern:

In compliance with the International Marriage Broker Regulation Act (IMBRA), I respectfully request for waiver on filing limitations in connection with my current petition.

A waiver is appropriate in my circumstance because I have no criminal history with regard to the “specified crimes” under IMBRA. I have one prior approved Form I-129F for Ms. xxxxxxxxxxxxx of the Republic of the Philippines, WACxxxxxxxxxx, MNL2005xxxxxx. Our relationship did not work out in the end so I did not pursue the petition anymore. [You might want to add more info here as appropriate]

Hoping for your kind consideration of my request.

Folks I need help, I a filing my second my second k-1 visa within 2 years, the instructions say I must file a waiver with new I 129. Where is this form or is it just a letter? Can someone help

yes we did one too, no form u will be the one to do the letter... u dont have to do a long letter just a simple, complete and concise...

A letter may not be enough..USCIS told me I needed to include documents to support my request for a waiver..

The waiver letter is all that folks send. If they want anything more they will send you an RFE but they know everything that you will be telling them anyway.

After a chat with the OP - he appears to have only two petitions. The trouble seems to be that the second will be within one year of the first. As we know, there is a two year limit. I don't know if a waiver works for the 2 year timeframe or not. Thoughts?
