My wife is a US Citizen, I'm a Bangladeshi and living in Bangladesh. Can she apply for me from Bangladesh

My wife is a US Citizen, I'm a Bangladeshi and living in Bangladesh.

She was married with someone. And has got the Divorce clearance recently. At the pending moments(3 years)of divorce clearance she was introduced with me. We have got married by just a Muslim religious system. But as that she could not get clearance so, we could not marry by court. Recently we have got a kid and the child has born in USA. I already fill and sent a fraternity form to the hospital by ensuring that I'm the father of the child.

I have some questions. I think this is the right place where I can get my answers.

Now my questions are:

1. Do we need to re-marry?

2. What form does she need to file? K3?

3. What information's do I have to submit?(My information's)

4. She will come after 3 months with our kid. Can she apply(submit file) for me from Bangladesh(American Embassy)?

5. If have to submit the form only from USA, then can she sent the file from Bangladesh to USA by Post or Currier Service?

6. How many days it may take?

Please help me with some information's. All kinds of information's will help me. So you are welcome.

1) Yes, I think you need to get remarry to make it official. If you want to marry in the U.S, you can start applying for a fiancée Visa now.

2) It is depend on whether you are trying to marry abroad or in the United States. If you marry abroad, you should use I-130. I don't know about fiancee visa though.

3) The application forms will address this question.

4) I don't think she can apply at American Embassy in Bangladesh because she needs to live there for a year to be eligible.

5) I think it is possible but have no idea. I don't think you can use Fedex or UPS to send to USCIS. I think you need to use DHL.

6) It depends on the carrier.

The previous answer contains mostly incorrect or incomplete answers.

1. To begin a spouse visa process, you must include a marriage certificate issued by the government agency in the country where the marriage took place.

2. There are a number of forms to file. See appropriate "guide" by clicking on the work "Guides" at the top of any page here. The K3 visa is no longer available. The available spouse visa applicable to newlyweds is the CR1 visa. Follow that guide.

3. Follow the CR1 guide.

4. No, she may not file in Bangladesh unless she has resided there for at least six months before filing.

5. She can file the petition via post or courier if she follows the correct instructions for doing so.

6. Your question about how many days seems to apply not just to mail time to file the petition but the time from filing to visa. Think in terms of 8 to 10 months, not days.

The bottom line is that you have to marry her, legally either in your country or the US.

You have 2 options:

- you marry her (offially :) ) when she comes to see you, and than she files a petition for you(called CR1)

- you apply for a finacee visa (K1) and you marry her in the US

CR1 - your wife files a petition for you,takes about 6-8 months,the good thing is that you can work & travel since you arrive in US and it's less expensive. There are plenty of threads on this site about the CR1 visa for you to read.

K1 - takes a few months to be aproved (go and check the threads about the K1 visa)once in the US you have 3 months to marry her.It's a few months faster but it's more expensive,complicated and you don't have the work & work permit right away, you have to do some adjustments and to file different forms for each one.

My advice would be to follow the CR1. You'll save money plus you'll have the green card once in the US!

Bangladesh has two types of marriage. The religious one and the court one. If you are religiously married in Bangladesh, the secular court respects that and considers you married. You can apply for a marriage certificate from your Kazi's (judge's) office. You'll be granted one. You might have to pay a fee. Don't know how much it is. And since you are married, you cannot file fiancée visa anymore. So this is my input. Everything else has been answered by everyone else.

14-JAN-2017 -:- N400 form NOA1 on hand through USPS

30-JAN-2017 -:- N400 fingerprint taken
