I am currently waiting for my NOA2. After reading much info on this site it occurred to me that we may have a problem due to 2 previous Visa denials.

Here is my story:

When I met Jenny she was already in the process of applying for a tourist Visa. She wanted to visit her sister who is a US citizen and visit me while she was in the US. She was denied because they said she didn’t have enough ties to her country.

Our relationship continued to grow and we thought that maybe she could apply for a student Visa. We had not reached the point in our relationship to become engaged, but I did know I wanted her to come be with me. I figured she could study for a year and allow our relationship to grow while she was here. I was her sponsor and we didn’t notate any romantic ties between us.

Once again she was denied because they said she didn’t have ties to her country. She provided all necessary proof that showed she had ties, but they wouldn’t even look at it.

My worry is now that we are engaged they will treat her as if she is only just trying to get to the US and our engagement is fraudulent. We were only trying to be responsible and allow ourselves time to ensure our relationship is strong. Im sure you all know the current divorce rates in the US. Building a relationship over thousands a miles with email and video chat is difficult. Fortunately I am able to travel to Colombia about every 8 weeks.

We have spent many weeks together.

What would be the best way to conduct ourselves at the interview? We have been honest on all that we submitted, but I worry that the previous denials will be the focus of the interview.

Any advice would be greatly appreciated.

Should not be an issue, previous visa's denied for no ties. Current application by definition does not require ties.

My wife had been previously denied a tourist visa also but we just received our NOA2 yesterday.

I don't remember which form ask if she had ever applied for an immigration visa and was denied. She hadn't. I don't think they ask any questions pertaining to tourist visas.

It will NOT be an issue. I've known maaany people here on VJ that went through the same fears as you. I myself have visitor visa denial, but that's not a problem because they only look at the relationship for a K-1. We're also waiting for our NOA2. Anyway, DS-156 Form asks about previous visa denials, but that's just about it.

I was denied when I wanted to visit my sweetie in the USA in August 2009. We were not engaged at that time and our relationship was not official(we only got engaged in March 2010). From September 2009 our relationship became official and he decided to come and see me for 3 weeks(this was the 4th time we met). From that moment on we were sure we wanted to spend our lives together and that I'd have to go to the USA with a spousal/fiancee visa when he was going to become a USC(he's from Romania just like me), which he did this summer.

Relax, it will be fine, this is very different from the previous visas and the decision will be made separately from those denials. Now the only thing that matters is to give them proof your relationship is bona fide. :dance::thumbs:

Keep your chin up and start thinking about marriage and AOS! Your interview will be a breeeeeeze. :P

P.S.: Maybe thought about going together for the interview? My fiancé is going to come for my interview and I'm sure it will be smooth sailing. It will also be smooth for both of you!!
