Hi everyone, I am hoping someone has had this happen to them and can shed some light for me.

I was preparing to file my petition complete with a $455.00 processing fee when I saw a bulletin for fee restructuring. The new fee cost for the I-129F is $340.00. The date the change goes into effect is Nov. 23, 2010, my head started spinning! Do I send the 455.00 or the 340.00? Well I did something very analytical and flipped a coin. So, $340.00 made its way to the Lock box on 10/26/10. Has anyone had a similar circumstance? I would think that they would look at the packet with in that 4 week window but I don't really have a clue. I would truly appreciate some feedback if anyone has any...Is it likely that the packet will be returned?

Since you have sent the package before the Fee-changes has taken effect you haven't sent the correct amount so it will be returned to you.

Since you have sent the package before the Fee-changes has taken effect you haven't sent the correct amount so it will be returned to you.

I agree. Packet postmarked/received prior to the date maybe returned. I hope everything works out for you.

How could you possibly be able to make this work for him?

USCIS will take one look at his package, see the incorrect filing fee and return it to him.

OP, either send you package right back to them with the correct filing fee, or wait until after the change has been implicated and send it then with the lower fee.

Oh wait...you can suggest that you were confused on a bulletin board and it will matter.

You cannot "make this work" for him. The fee amount is incorrect, plain and simple. It won't be accepted.

If the fee changed November 23 and you sent the petition AFTER that date, the correct fee is $340.00 Any other amount would be rejected and sent back for the correct amount.

DO NOT use a coin flip to make decision in this process.

Thanks everyone I got the advice and the joke were all good. Well not really but what are you going to do. Based on what I had read they would get around to the packet until after the 11/23, but never thought about the postmark date. Anyway thanks for the input...
