I-864 Documents

I'm just wrapping up our I-864 and I want to be extra clear on the supporting documents I have.

I have:

1. Letter from Employer stating he's been there for 10 years and makes $xxK annually. (yes, 125% over poverty level)

2. 2009 Tax Transcript

3. Three months of pay stubs

4. Statement of 401K (even though we don't need it I read it was better safe then sorry for assets)

Do we need anything else?

I was told to include 6 months of Bank statements as well. Not sure exactly what that accomplishes but I don't see where it can hurt, especially since I have set up a separate bank account with Schwab that she can withdraw money from in China. Not really a proof of income thing but it will give us more evidence of a bona fide marriage I hope.

From other threads that I have read, many people got RFE's for the tax transcripts if they only included one year and not three years. No idea why as the form says optional, but unless there is a reason not to include them it might save some delays on the back end.

I included #1, #2, and only the latest paystub for #3. we didn't include any bank statements or anything like that.

I added a note to the paystub which showed the calculation from one week's pay to the annual amount I quoted.

We included only #2. As my (now) husbands income was above the line for his 2009 tax return we didn't need anything else. The others are ONLY if you need extra documentation to prove his CURRENT income is above the line. If you have an interview you may be asked to present #1 and #3.

The AOS thread in my signature should help you I was approved using the lists there with no RFE and no interview.

Agreed - we included our tax return for 2009 and the W2 (with the transcript you don't need the W2) and nothing else. I printed pay stubs and employment letters for the interview, but didn't get asked for them.

I suspect it's somewhat about how much over the 125% poverty line you are. Someone earning just over, would probably do well to add some extra evidence, someone earning $500,000 a year probably doesn't.
