i am so sorry my love. i feel a complete blonde on all this.. i think we need a heck of a lot of help on all this because i feel like a huge boulder and its not easy to get off... so we might need a few more yrs to save up and understand all this stuff cause i feel like crying lol... grrrrr frustrating.. all i want to do is love you and all they the visa etc wants to do is break us so we have to struggle to survive after we pay them off. lol grrrr im sorry im not rich.. i only am ri\ch in kids and thats it... :(

If we had a bank account in her name in the US with the amount of the poverty line, would that be enough to meet the requirements of the sponsor thing, or does it have to be an actual income, showing that is what she earns in a year. So if we had say 20k (or whatever the amount is for the poverty line 25k i think) in a savings account would that meet the requirements of the sponsor part although she doesnt make 20k a year.

Also when working out the poverty line, do i need to include myself in the family number, think i do but just want to make sure

That may work. You need to do some research on using Assets as the basis of your support. The financial requirement will be higher than if just using income.

Make sure you look at using Assets for both the I134 for the K-1 and the I864 for the AOS.

I think that assets must be 5 times the amount required. So if for example there are just the two of you in the family than she would need about $18000 in income or $90,000 in assets. Someone please correct me if I am wrong about the exact amounts.

Typically it needs to be income. It's a bit fuzzy, but just having $20,000 in the bank isn't enough. For one thing, sponsorship entails a three year commitment. However, the $20,000 could cover part of the minimum income, and I have heard different figures - one lawyer said assets could count up to %30 of the minimum income requirements. Of course if you have like 100 K in a bank you probably won't have any problems.

All in all, they are mostly looking for a steady income stream, either through a pension or a job.

add another $350 for the actual visa, paid at the embassy and add $100 (depends on the country) for medical exam/certificate.

Isnt there a few other fees to be paid in Peru also? I will check some e mails from a long time ago, but a friend of mine did this also, and in her packet 3 she had another fee too.

I thought the beneficiary on these things could use assets of his/her own? Is that only when its a spouse VISA not a fiance VISA? Not sure what the designated amount of assets is , but money in the bank for a year or two equaling the difference between what she has as income and what the poverty guidelines say for the number of people in the household should do it.

If they don't let you use assets for a fiance VISA then the marriage route might be the way to go if you cannot secure a co-sponsor.

She will have to have a legitimate income source,even if you guys have 20K in the bank she will need to show her last three years of income tax return. Even if she has a co sponsor that might put a red flag at immigration. You have to know that every marriage petition they consider a fixed marriage until you prove them otherwise. Her not having a job and having that much money in the bank they will definitely tag your petition as a fixed marriage. Not to rain on your parade but filing the petition the right way the first time will save you guys a from spending a lot of money and headache. Just because she is a USC she can petition you anytime they also look at her capabilities as a petitioner and make sure you get all your proper documents ready to improve chances of getting approve.
