Dear VJ people:

In our quest for sponsor in the filing of AOS, we came across a lady who wants to help. She earns about $30,000 a year and has 3 kids under her care.

The question is, is this lady eligible to sponsor me since my wife does not work right now?

Your answers are urgently needed before she changes her mind.

Thank you.

The worried Ken.

Probably not eligible. With herself, her three kids, and the sponsored immigrant, her household size is 5. The minimum income requirement for a household size of 5 is $32,237 (unless she lives in Alaska or Hawaii, in which case it's more). The shortage is not much - only $2237. If she has assets she could use that are worth at least $11,185 then she could qualify. Does she own a home with any equity?

I disagree. My husband was my ONLY sponsor and earnt just over $19K. For a 2 person household he needed $18,212. We were approved with no issue. Over the 125% is over.. doesn't matter how much.

Take another look at the numbers. The co-sponsor has an annual income of $30,000, and three kids. When you add the immigrant, her household size is 5. 125% of the poverty guidelines for a household size of 5 is $32,237. She's not over the guidelines - she's a little under.
