Due to unfortunate circumstances, I desire to no longer stay in the US. I have my biometrics scheduled for next week, which I will do, but want to go back home once that is done. What happens if I do this? Will I in the future be able to visit on a Visa Waiver? Or obtain any other types of visas, such as student or work visas? Or will it be impossible to return to the US as a tourist if they see that I once intended to stay here permanently? I am married to a US citizen since a few months back.

What is the basis for your AOS application? ..

seems like if you are married to US Citizen and abandon your LPR status you will have basis to re-apply as spouse of US Citizen...unless marriage is on rocks or something.

Sorry,

really not sure on this, I assume if you are still married to US Citizen you would have to re-apply for spouse VISA or if on tourist because you are already married.. then establish that ties to your own country are strong to visit on a tourist visa in the interim.

If the stopping/pausing of the AOS process is due to failure of the marriage then after divorce is final shouldn't have tourist visa issues.

You said you no longer wish to stay but the answer I give relies on some info:

- are you divorcing the USC?

- are you and he simply moving to another country together?

Your title is can it be paused, not really. You can change interviews and such but you can't really pause it. Even changing interviews is risky.

If you want to WITHDRAW that's fine. You would write a letter to USCIS withdrawing your AOS application.

Doing so will NOT affect your chances of VWP, depending on any length over overstay you currently have.
