First, I want to thank everyone for all of their insight and advice in the K1 process. VisaJourney has provided me with a wealth of information. It’s been great to read about couples in the same situation as my fiancé and I.

I apologize in advance if this question has already been posted and answered on the forum. I searched around for it, but couldn’t seem to find it. My fiancé is moving here in late December and would like to start working as soon as possible. When is the earliest that he can complete the “Employment Authorization Document”? Can he do it before he moves here? Is this the only documentation needed for him to be eligible to work here in the U.S.?

Thank you in advance for your help here.

As a k-1 you can file for the EAD after arrival in the US. I don't remember the exact cost but it is around $350. BUT it expires the same time as the I-94 expires so about the time you receive it you may have a few weeks to work before it expires and you must quit the employment.

A better option is to marry as soon as possible, in some states the same day as arrival, walk the paperwork to the clerk's office and obtain a certified copy of the marriage certificate. Have the AOS paperwork including the EAD application ready to mail (take it with you and just drop the marriage certificate in the envelope and mail it on the way home). TADA EAD obtained in 90 days or less of arrival. And while you are waiting go to the social security office and make that application so he has his SS card when the EAD arrives.

He can start looking for and applying for employment prior to the arrival of the EAD but he cannot begin work until he has it in his hand.

You can apply for the EAD along with the GC which is part of the AOS process. The can not apply for AOS until they come to the US and then after you get married.

As stated, he can pay for an EAD when he first arrives but by the time he gets it it will only be valid for a short time then he will need to stop working until he gets his GC or EAD from applying for AOS so it's a complete waste of money.

Best bet is to get married as soon as he arrives and file the paperwork ASAP. You can start working on the required documents now so that all he needs to do is sign and attach to copy documents. See here: http://www.visajourney.com/forums/topic/235331-aos-ead-ap-from-k1-the-aussie-way-doc-list-included/ which should help you.

Good luck

** moved from "K1 Process & Procedures" to " Working & Traveling During US Immigration" as this is relating to an EAD **
