I need help real bad please :( need advice

my boyfriend soon to be fiance live in canada. he had a visa for USA but went to canada instead and decided to stay. so they took all his documents and told him that in 18 months to two years he should get everything back and become residence. now we are madly in love and thinking of ways to be together and marry. we were thinking of the fiance visa thing but...what can we do? i feel it is impossible for us to do anything with what he has going on being in canada. please any advise will do.

if he's legal in Canada - then you might consider moving to Canada, becoming permanent resident there - the quality of life is much better than the USA.

If you truly wish to 'get him to USA' - then suggest you submit a new I-129F petition for a K-1 visa.

he did suggested that but my mother just move to the USA and this is such a big transition.

if i send a I-129F will that stop him from being legal in canada because they are working in his case to be legal

Im not too familiar with this but since his process to become legal in canada is basically pending and hes waiting couldnt he just call them and have them cancel his file or something of the sort so that he can return the united states (since thats where you wish to reside)

If he's a legal resident (doesn't have to be a permanent resident) of Canada then his case will go through the consulate there. If he's not a legal resident in Canada then his case will go through the embassy/consulate in his home country.

Study the K1 guide here on VJ and decide if that's the right course for the both of you. If so, then file the petition and let the games (and waiting) begin.

A visitor's visa for 5 years? Don't think so... Ask him and find out! Could save you a lot of hassle if he has a valid work or student visa...

Yes, there are tourist visas issued for 1, 3, 5 and 10 years - sometime even for as little as 3 months or a week only. It does NOT mean someone can stay in the US for that long usually on B1/B2 max time is 6 months - all depends on what is written on I-94 - that is the time given to the visitor to stay in the country. Visa just allows one to get to the US border.
