I864 Affidavit or support, is a letter of employment required?

Hi everyone,

I am a US citizen. My wife is a "foreign national" from France. We recently submitted our AOS package to the Chicago lockbox, got a receipt notice on September, 2nd 2010 and are waiting for the bio appt letter.

I submitted an I-864 form with all required evidence, however ( because I have not been employed for too longer since I was a student until very recently) I asked a family member to fill out an I864 form and give us all the required docs.

I sent the AOS package without my uncle's I864 but I am keeping just in case we are asked to have a joint sponsor.

As you can imagine, I wasn't very comfortable about asking my uncle to do that but it wasn't a problem at all. Nevertheless, I have read that if we ever use him as a joint sponsor, USCIS could ask for an employment verification letter from him, is that true?

Like I said, I already didn't feel comfortable after asking him to fill out the form and give us the tax returns and W2 so I want to know if the letter of employment is really requested If so, when in the process? Can't copies of pay stubs be sufficient?

Thanks a lot for your help folks! And good luck to you all in tour cases. I'm looking forward to the day my wife gets her green card as this process puts a lot of stress on me, the USC. Ironically my wife isn't stressed out :)

Adjusting from J1 Trainee visa:

August 25th, 2010: Filed AOS package to USCIS

August 27th, 2010: Package received by USCIS

September 2nd, 2010: Received I797 for I-130, I-485, I-765

October 14th, 2010: Received biometrics appointment letter (will be on Nov 5th)

AOS interview will be on January 13th, 2011!

January 13th, 2011: Approved at the day of the interview

Next step, removal of conditions

Timeline

A sponsor's current income needs to be verified. An employment letter and recent paystubs are typical proof of that income.

IF they ask for the letter it will be at the interview stage, if you get called for one. So, give your uncle the heads up now that you MIGHT ask it of him but that you'll have at least 2 weeks warning. Best case scenario you don't have an interview and you don't need the letter :)

My husband and I sent in only his tax transcripts and were approved without interview :)
